  • Someone over on Avforums reckons one of there orders (at £209) has been shipped. I suggest everybody phone currys with this info tomorrow and find out why??

    They cancelled my order I haven't been in contact with them other than a letter to MD that they won't have received yet!

    hmm.....their email is incorrect.....if they have taken payment they have entered into a contract with you and must supply the goods

    Blimey....dont like Dixons as company...they even think they are above the law...do they think their customers are stupid.....

    They made an error....a misprice....fine, so what....that has NOTHING to do with Contract Law......

    1) Dixons made and "offer" on their website, which is incorrect
    2) customer orders it.....at this point no contract has been formed
    3) Dixons takes money from persons bank account....at this point a contract has been formed...Dixons either have to honour the deal unless an agreement is reached by BOTH parties

    ...Dixons have taken it upon themselves to cancel the contract...er no you cant...I am also surprised with the poor email above from someone who obviously knows this and is trying to "get away it".....poor Customer Service

    The last statement with regard to availability is irrelevant.....

    Also, if Dixons do honour it, then you should be first in line when stocks are back in....they may try to delay your order for a long time, knowing how crap this company is

  • not quite true - here;s the steps if your fighting dixons

    1. dixons made an 'invitation to treat' by advertising the product on their site at £209.99
    2. you made an 'offer' by purchasing the item
    3. despite not sending the third e mail confirming acceptance of the contract - in british law, taking payment constitutes acceptance of a legally binding contract
    4. last part needed to form a legally binding contract is 'consideration' - that's the £209.99

    going to pen up a letter to them today and see what they have to say

    Is this not the same as the 49p tv from Argos?
    Argos took payment, but nobody got their TV's.
    There's probably a clause in the T&C's which you had to agree to before your order went through which states the contract isn't complete until the item is dispatched. Whhether this is legal or not I don't know, but if you ticked a box agreeing to the T&C's there's probably very little that can be done.

    Saying that, keep pushing, you never know your luck!!

    yes but T&C's are written by someone at Dixons and do not supercede any contract law....not sure where you'd stand if you ticked the box though....however if you had to tick the box to proceed (ie. it wasnt optional) then i think Dixons couldnt argue that as a case for non acceptance of the contract as it wouldnt be a fair one
