Apple ipod 4mths old, screen failed options?

The whole thing just died, wouldn't work, wouldn't do anything so on the form I said "it died" and that seemed to be enough.0 -
I have filled in their online "service" from, it doesn't mention "screen failure" as a defect or service item , so put in another item.
I have photographed the screen defect for my records and await an e-mail from them as to how to send the ipod back to them.
I will keep the board appraised of the outcome.

Now I have an e-mail back to say they are sending out a new colour screen plus fitting instruction.......!!!
Will keep you informed, now as it turns out our next door neigbour has had the same problem...but kept quiet about it!

Hi board, sent the ipod to Apple, Cork; got a phone call today form them to say that items requiring repair are sent to their international repair centre in Holland.
Secondly, they would not repair it anyways as it was a screen failure, NOT COVERED under their "limited warranty" terms, see on their site.
The item has suffered no external damage and has been carried carefully in one or two pockets of my sons jacket/trousers without any problems. The guy from Apple said that pressure MUST have been applied at some point to the screen to make it fail, therefore its the fault of the customer, no ifs, no buts ...zilch!
He did not nor could not define what "pressure" ( ie amount or type torsional/direct/indirect) could result in failure, nor is there any notional limit etc, but that it can stand up to normal pressures!
Still hacked off, they are sending unit back, with some advice re claiming under insurance, NOT A HAPPY BUNNY!!!
Any more advice..............I hope some one can help..........! Anyone had a similar experience and got them to repair an item?0 -
i would have anther go at them a preach the asales of goods act to them and tell the there limited warranty is extra to uk law and not get off the phone until it's sorted and speek to a manager or some one high up ( ive had same sort of thing with a mobile phone that was bought over the net
P.S. have sale of goods act open on the pc so you can quote stright at them ,word for word if neededthere or their,one day i might us the right one ,until then tuff0 -

As its under 6 months old they have to proove its not faulty after 6 months you have to proove its faulty so as its been only 4 months i would ask for proof and a written report as see what they say.0

They failed to respond to the sale of gods act reference - quoted their limited warranty....how can they get away with that? They know which part is most easily damaged, ergo they know it won't stand up to regular use, and absolve themselves of responsiblity??? ie not fit for the use to which its put!
Its now 6 weeks, not of a mind to spend much longer, quickest remedy?
Credit card or small claims court, other options...these people really hack me off!

The phrase 'this does not affect your statutory rights' comes into play here, your statutory rights being the sale of goods act. These rights supercede any 'limited warranty'.
