Im not saying thatwhat apple are doing is correct or not, but involving and defrauding another company isnt right, this site is about getting the most out of companys but not breaking the law.0

How are you defrauding argos? You take it back,they send it back to apple and get a replacement,so the ipod ends up back where it should be.......©..®..(TM) NothingVentured.

You said a minute ago it goes to a warehouse that sell returned goods in job lots , but now you are saying it goes back to Apple?
If you didnt buy it in Argos then you cant expect them to take it back and if you did you are comiting fraud no matter how you look at it.0 -
When the screen went on ours a couple of months ago we looked at the apple web site, filled in the form for service there and emailed it back to apple. They sent us this in return:
Thank you for your order. A service request for your iPod has been placed. Your dispatch number is: xxxxxxxx
You will need to send your iPod to Apple before Apple can send you a replacement. A shipping box will be sent to the address you provided. It will include instructions on how to return the iPod to Apple.
You can check the status of your order at any time at:
http://www.apple.com/support/selfservice/status
Please note:
1. Only send the iPod for service. Do not send any additional items (such as power adapters, cables or cases) as they will be discarded and will not be returned.
2. Pack the iPod properly using the packaging provided. Any iPod damaged in shipping as a result of improper packaging will be returned in the condition received. In addition, any iPod damaged during shipping is not eligible for warranty service.
3. Backup the data on your iPod. During the service process, your iPod may be replaced by a new or remanufactured iPod which does not contain your data.
If you have been requested to send in your Proof of Purchase, please fax or mail it as follows and include your dispatch number.

Jaymac, thanks for your fulsome reply, will check it out, can you tell me how your screen failed etc, was it your fault ( dropped..hit...in a bag...or pocket etc), or just didnt work?

Contacted Apple today, to be told, that screen failures are not covered under warranty!! This is breath-taking and I am not a happy consumer.
Let me know the options open to me, I realise that Apple have a poor customer relation reputation but they shouldn't treat consumers in this off hand fashion, all help, suggestions appreciated.
what a load of rubbish they told you......it is covered unless its caused by your sons misuse or accidental damage.
If it has been caused by a manufacturing defect/failure of the product then it should covered under the Sale of Goods Act

most people dont realise how well we consumers are protected and companies abuse that lack of knowledge....
However your contract is with the shop in the first instance....you should only go to the manufacturer as a last resort.....unless you bought from them directly
Who did you buy the item from.....you should go back to your seller. If its a shop then your contract is with them....dont let the shop fob you off by advising you to go back to the manufacturer....as its under 6 months old and assuming it was a manufacturing defect, then they should offer you at least a repair.....although if i was you and given it isnt very old i would speak to the manager of the shop and demand a replacement. Stand firm and dont given in.
write them a letter (send recorded) firm and professional first...log everything....times/dates of phone calls.....eventually they will give in

Options, to make a claim via credit card or small claims court ie item sold not fit for the purpose for which it was sold? Hoping to get a reply from someone who the same problem ( which has shown up on the nan ipod by the way - apple then reluctantly replaced those!!!) and were successful in making a claim for either repair or replacement.

if you bought it online then you are covered by the Sales of Goods Act (and the Sale and Supply of Goods to Consumers) and the Distance Selling Regulation (see below).
