Hi Guys
Update.. He had the meeting , HR and a line manager , they told him at the end he had done `all he could` to save his job , and that they would decide , in writing by the end of the week...he hasnt heard anything yet , he`s waiting for the postman bless him
Basically it looks like a bad language problem , grumpiness with customers etc , no customer was sworn at or anything though otherwise he would be gone by now they told him
He had the idea of writing them a letter straight after , and this is what he emailed me that he sent...(Recorded del)
Dear *****/*******
Further to our meeting earlier today , i thought i would write down some thoughts , and put them over to you via a letter.
I am desperately disappointed in my behaviour that has resulted in this disciplinary action , and thinking on as regards to ****l at ******** , i still cant recall with any great clarity but i think i may have said "nothing will change just going to the rep" or something along those lines , don't quote me on that but it`s possible that what was said.
I just want to reiterate that i ENJOY working for **** ,the people are good , with great qualities , all the way up from the bottom ! , i have a good relationship with the majority of my customers , people that only ever ask for me and nobody else , people like *** at ******** who without fail will give me a large site delivery order every couple of months , ***** at ******* , one of the biggest spenders on my account , he always comes to me because he knows i will bend over backwards for him !
What i can PROMISE is that EVERY customer from now on WILL be a **** or a ****, without exception , i am having the biggest scare professionally that i have ever had , please let me prove to ***** that i can be as i said , a brand new invigorated employee , once again a valuable member of the team that can help the company overcome the difficult tasks and challenges that lay ahead.
In no way are these excuses , but i have rang the doctors to chase up my counselling appointment as its been weeks now and i feel that will really help me professionally and personally to get those sessions going , this , along with the process that is taking place now with myself and ***** , has made me even more determined to show everyone that i can be , and will be a valuable person to have with them at work.
I am more than willing to write everyone concerned a personal hand written letter , explaining myself , my aims for the future and how i can be relied upon to not let ANYONE down again , as i mentioned at the meeting , please feel free to put me on a probation period , 1 week , 4 weeks , a year even !! , i will prove that i can once again be a valued , integral part of the **** family , please give me the chance to vindicate any faith you can or do show in me , i will NOT let anyone down this time , my word is my bond , please take my guarantee that all staff , BDM`s , colleagues , Customers , will receive , from now until infitum , **** ***** best possible helpfulness , customer service and respect.
I don't wish to come across as begging , more as someone that has realised that he has lost his last life and will treat every day , every customer , every colleague with the respect they deserve , each and every day.
Please feel free to show this letter , as my full and guaranteed intentions to ANYONE at the **** organisation that i will , if given the chance , not let anyone down.
Thank you for taking the time to read this letter and also for doing me the courtesy of keeping me `in the loop` every step of the way.
Best Regards
They do have the option of a final written warning , but he thinks it`s 50/50
Any thought ?

I used to employ a fairly big team and swearing at a customer was an instant written warning... My team was international and that meant swearing could happen in anything up to 12 languages which made it hard to enforce - however people usually got the hint after a verbal (confirmed in writing) warning regarding their conduct - if they didn't then I'd have had no sympathy and happily moved to final written - if there had been enough complaints (and sorry to say it sounds like there is!) then I'd have dismissed them for gross misconduct. The letter he sent is not one I would expect from an Account Manager - I'm sorry but I might expect this from a 1st line agent or an entry level employee in the organisation... It wouldn't have cut any slack with me as a manager.
IF he keeps his job, then he has to know that so much as one step out of line will cost him his job. If I were him I'd start looking for a new job even if he gets to keep this for the time being...
He obviously didn't change last time he was diciplined so why is this different? I wouldn't as an employer trust him to have changed - it's a risk I'd feel I couldn't afford to take. Right now more so than ever before service and reputation is everything if you want your business to survive. I'd see him as too big a risk.
I guess the best advice you can give him is to come on these boards - post an SOA on the DFW boards and let the guys and gals there help help as much as they can with controlling his budget...DFW Nerd #025DFW no more! Officially debt free 2017 - now joining the MFW's!
My DFW Diary - blah- mildly funny stuff about my journey0 -

Well , they sacked him , but they have `as a gesture of goodwill , recognising his remorse at the hearing` paid him a months wages even though it is officialy `gross misconduct`
Thanks for all advice0 -
ach well,i suppose a months wages is better than none.
anyone he's friendly with who could sort a reference?0 -

Maybe , he`ll work summat out , the least he can do is get some temp work somewhere to tide by and like you say the months wages will make it as if he`s still working , up till this point next month anyhow

You don't sack someone then give them a months wage as goodwill.
I would recommend either he sees a solicitor and considers an employement tribuneral or he request that they let him resign and expunge any record of this "gross misconduct" from his file and provide him with a reference and in return he won't go the tribuneral route.0
