How can my brother avoid the sack ??

What i am most worried about is this payment equal to a months pay , if i apppeal the dismissal (which has to be within 5 days of receipt of the letter (tommorow) they will presumably stop that payment , and maybe not pay it at all , so i feel they have me by the balls !!


The dismissal letter goes like this...


Having reviewed your responses to each of the allegations made the company finds that you did not provide counter information that could prove the allegations were unfounded.

After further investigation and du consideration the company finds that the complaints against you were well founded.Each element has been reviewed in isolation despite the possible casual link between them.Each was found to be wholly unacceptable to the company and of such a serious nature that a gross misconduct claim is a reasonable penalty .

I am therefore writing to to you to confirm the desicion that you will be dsimissed from this day the 24th October.

For the avoidance of doubt the reasons are ;

Due to the fact you are dismissed on grounds of gross misconduct you are not entitled to a payment in lieu of notice , however the company wishes to recognise the remorse you showed during the hearing and in this is willing to allow a good will gesture in the form of a payment equal to a months salary For the avoidance of doubt this will be subject to tax and NI in the usual way.

Your final pay slip and P45 will be sent on in the next few days

You have the right to apppeal this descion , should you wish to do so this must be in writing within five days of this letter

There is my problem , i never got to SEE any evidence , i was akes what I could recall from certain situations but as i couldnt recall with any clrity anything in particular , they never showed me after that what it is i was supposed to have done , so they never shwoed me this evidence and i couldnt refute it in any case !!!


Any advice welcome !
