    I once bought a DVD box set from a mega lister on ebay only to be told it was not available. However they still had the original listing showing so I phoned Amazon and asked whether it was against their rules to sell somethign that was not in stock, and they said it wasn't encouraged but that a seller can do this if they have a back up supply. That seems to go against the spirit of Amazon but CS were equite happy that sellers can do this. The correct term for it BTW is drop shipping and that is even allowed on ebay!

    However I don't think the word 'illegal' is used correctly as there are certainly no UK laws which say a retailer must have everything in stock. Can you imagine the confusion if they did..I could personally have sued Waterstones twice this week for cancelling out of stock items they can't get despite me having ordered them a month ago..and one of those items is still shown on the website :confused:

  • if hmv were out of stock the seller could of bought it from plenty of other places, unless it was a rare cd, so there would not of been any problems with delivery to the buyer, and think its a brilliant idea of the seller to do that. I think he should get positive feedback as the cd was delivered correctly and promptly, the price you paid was a price you were happy to pay at the time. You really should stick with large companies who can give you no quibble refunds.

    There is also a no quibble refund on Amazon even from marketplace sellers. OP can get their full original payment back as soon as he returns the items unopened.

    If he had a contract with a supplier..then fair enough...but he doesnt and its clearly lying if he states on amazon HE has it in stock.

    The point isnt that the buyer made a mistake, its the unprofessionalism of the seller, regardless of this case.

    Ifs, buts and maybes. The facts are the seller sold the DVD to the buyer and the buyer received the DVD in good time. Now the buyer is whinging because he found out that he could have bought cheaper if he bothered to look.
  • Sellers are obliged to have the stock in hand. Dropshipping, unless Amazon are doing it for you, is not permitted. That is Amazon's terms and conditions. Yes the original poster was lazy in not looking for the better bargain - His fault. Because the seller operated outside of Amazon rules, the seller is no position to demand anything. If necessary, Amazon WILL issue a refund, then take it from the seller. The demand for positive comments before any action will be taken is blackmail. If the seller had these as a stock item, but had failed to remove the stickers etc. it would not be an issue. Well the op would still make an issue I assume, but not this one. I say A-Z him - give Amazon all copies of communication - and next time shop around. The lessons to be learned here are..... BUYER - You've got the net to do your shopping - DO IT PROPERLY..... SELLER - Sort your act out and hold some stock, or this will happen again and your reputation will fall. Also you stand a chance of Amazon closing your account. .................................................................................     The user agreement states that "You must dispatch the item to the buyer within two days of receiving this e-mail."

    According to Customer services when I made a complaint a while ago as long as a seller can despatch within the time frame stated they do not physically need to have the item in hand. I have searched high and low through the user agreements to find somewhere that states drop shipping is not allowed but I cannot find it specifically stated.

    To my mind that about sums it all up and thank goodness another couple of people are of the same mind as OP and I and reading it properly. I hope OP gets Amazon into looking at revising the way sellers offer their (or not their!) items for sale. If it comes via a middle man, who at the point of sale, does not exist, then it's wholly wrong. If Amazon issue a refund ....then they can't be thinking differently either!!!
