Problems with Amazon seller

Ordered some DVDs from Amazon Marketplace. Received in professional packaging. Opened package and it had HMV stickers on it with the price.

Now I paid about £14 each for 2 DVDs. They had £8.99 stickers on them. A quick search tells me they are £9.99 each at HMV.com. Silly of me - I should have done a better search before buying!

I contacted the seller and asked them if they had just ordered off HMV and put my address is the despatch box. They said they had, they work with many suppliers and have a special 'non-public' price.

Now I'm not happy with this. If it had been their company in their packaging it would be OK, but someone has just gone to another online shop and ordered the DVD with my address. The price on HMV was free delivery. They said they normally repackage the item but because they wanted me to get it extra quick 'they asked HMV to send it directly to me'. That banks them 2 lots of £1.24 Amazon postage credit.

The seller then said I could have the postage back, but only if I left positive feedback. I rejected this as I said I would leave feedback at my discretion at the end of the matter. I then asked for a full refund, to which I got this in reply:

I need to know the following information before I can forward you the returns details.

a) When was the item received in the mail?
b) Please confirm that you understand that you are solely liable for the item whilst it is in the post being returned to us in case of delay or loss and that we strongly advise using a recorded delivery service
c) Please confirm that you understand you must return the item at your own expense
d) Please confirm you understand that, once we receive the item back, it will be checked by our loss prevention department (that it is sealed & that it is the same item we sent you), and that a refund, if appropriate, will be processed via Amazon within 14 working days.
e) Please confirm that you understand that if we suspect that fraud is taking place, we may pass your full name and address on to the police and our own lawyers for the purposes of loss recovery and possible criminal prosecution
.

Now I believe this might be a case of one person in their bedroom playing with their student discount card, ordering off HMV and sending to Amazon buyers. I don't want to knock their enthusiasm for business as I'm all for promoting that.

What should I do? I'm sick of tired of sellers who do not take responsibility and try to do everything possible to get out of a refund. I also do not like people using terms like 'special non public price' and 'loss prevention department' when they are possibly a sole trader buying and selling stuff from a bedroom.

    what should you do? check www.find-dvds.co.uk next time you want to buy a dvd online

    i don't think they have done anything wrong. you got what you paid for.

    i think you'll find most sellers of new dvds on amazon buy them elsewhere for less.

    Yes I know people buy for less elsewhere. If they had sent it to me in their packaging it would be OK, but letting HMV send it is very unprofessional and is not what I expect from Amazon sellers.

    I'm sure HMV don't appreciate being used as a drop shipping service.

    But under the Amazon A to Z guarantee I am entitled to a refund, for any reason at all. From the contact I have had with the seller it has become clear that they have no intention of refunding me. I will not lie on feedback to get my money back - I don't stoop that low.

    In most cases this is acceptable...HOWEVER...they have to garantee that if they state their item is in stock...then it is, Now if they order from HMV after you order, they cannot garantee HMV have it in stock...and therefore they cannot garantee it.
    This could lead to customers not recieiving goods if HMV run out.

    I would report them to amazon under this pretense, and see what they say about him.

    Why try to get them into trouble given that they've done nothing wrong.

    OP should have looked harder, and is only whinging because they were less at HMV?

    I don't want to be mean OP but in effect you are paying for the time the Amazon seller spent doing the searches you could have done yourself if you really wanted to. I understand that you are a bit narked with yourself but it's totally unfair and a bit petty to take it out on the seller when it was your own mistake.

    It is your fault for not searching elsewhere. The price they paid is going to be less and I would just forget about the stickers.

    You were happy to pay that price and they tirned up quickly that is the end of it and you also learned to shop around.

    It reminds me of some of the seller threads on the Amazon boards where sellers give examples of having got poor feedback for having sold a book at more than cover price. I recall one who sold an old ladybird book with 6d on the cover and got 3 * for having sold it for almost a pound!

    I wonder should i feel guilty about the book i sold recently for £47 where the DJ stated 19/11d?

    I'm gobsmacked by the recent comments.

    HMV is not a dropship service. I paid for a service where I thought I would be dealing direct with a seller, not a seller and HMV.

    The seller is demanding positive feedback in order to receive a refund - that is wrong and very unprofessional. I am entitled to that refund should I wish, and I should not have any conditions imposed on it.

    Yes I'm unhappy I didn't spot the cheaper price elsewhere, but I am unhappy about the level of service I have received from one person in their bedroom pretending to be a large DVD outlet.

    You are all missing the point - if I received the DVDs direct from the seller then I would not mind having paid more. I am upset at the sheer laziness and unprofessional attitude in just ordering from HMV and forwarding it onto me.

    It seems to me that anyone who is uncapable of running an established registered business with good customer service sells on Ebay or Amazon. I know there are many good Ebay and Amazon sellers but in the past I have been let down so many times. Particularly on the refund aspect - sellers breaking the law and not accepting refunds.

    Well you know not to shop on there again then don't you if your not happy.

    I like to shop at places that follow retail laws and regulations.

    Would you like it if you wanted a refund from Boots but had to write a letter of praise to the shop manager in order to get it?
