Council/Posession Order and Me

  • Hi All

Im seeing this through till the end, have just come back from Birmingham airport with my other sister B and the OH, had to go pick up a 7 seater as I have to be down at Heathrow at 7 am to pick up other sis J and her hubby and my lovley new neice and nephew:j :j :j , Rotweiller can naff of till Monday morning then Im ready to do battle once again:D :D .

OH has been fantastic with me , to be honest if he hadnt been in the background through all of this I dont know what state Id be in, Have had a brill afternoon with my sis B and her son Liam, hes the best thing, much better than any old anti depression tablet, times like these you know who your real friends are so thanks guys....and if your sneaking a look at this B:rotfl: :rotfl: :rotfl: caught you out:rotfl: :rotfl: .

I wouldnt speak to anyone in a position like Im finding myself in the the way Ms R speaks to some folk, but what goes round comes round in my opinion, just because people are down on there luck theres no need to rub there noses in it. I just wanted to give her a good old punch in the nose:eek:  but have come to realise that theres more than one way to skin a cat/dog/council bully, maybe shes secretley suffering from depression herself:confused::confused: and thats why shes snappy and touchy, I am trying to make allowances for her behaviour but really dont see how she can be so unfeeling, I know there are set rules to follow and the local councillor said she has the final decision in who goes to court/posession orders/evictions etc but even he said there was no reason for her to go after me the way she has....have a suspicion that she has riled a few folk amongst her work colleagues as well, so lets see what my appeal brings then I can go from there.

R:confused: ight must get some sleep as I and OH have to be up at 4am to go down to Heathrow and get the sis and family etc...so will post tommorow afternoon and catch up with you all then.

Once again thanksso much for your support...night all xx

YOu have both made me laugh, and laughter is often the key to staying sane.

Have a wonderful weekend Anne. Enjoy it to the full.

Sorry Anne, nothing excuses her attitude, lack of person skills or any trace of being human. Human beings are supposed to care about each other, they have built in factors in their brains to hold out a hand to others, help, listen and be caring, when they fail those tests they are not HUMAN beings, they are simply robots doing a job. When they lose the lack of the human touch they may as well give up and go home, or basically change there bloody job!

So she hates her job, why take it out on people she is supposed to be there to help, or she loves her job and relishes making people skirm, cry, bend over in embarrassment, or commit suicide, how the hell does this witch sleep at nights.

I was brought up to see the good in people, but also acknowledge not every one is good, ie murderers, rapists, child abusers, wife beaters. But on the whole people are kind, considerate, helpful, caring, god what a let down that was then! Nah Anne kidding as most people in my book are nice why do you and I and others seem to meet the w*nkers of the world! Mind you I think rot the cow has finally met her match.. go for her Anne.. cor would love to come up there or down there with a plackard outside the council offices with that pic from Dez and her name underneath it... power of the people Anne.. remember that, or someone else will commit suicide due to this witch and her tactics.

Wonder if she has a hubby.. poor guy!

Hi Annne my sweet. Enjoy your weekend with your family and your new additions. As you said children are a wonderful tonic.

Glad you have got the right people on your side and I hope Ms R gets what she deserves. May I just ask if you told her you were taping her. I thought that if you were to record any conversation you had to tell the other person or you were in the wrong. If you did tell her then that makes it doubley worse.

(((hugs))) to you and the OH and you go get 'em girl.

  • I was suffering from depression later diagnosed as Bi Polar, and had taken sick leave off work supported by a medical note..later got the sack and am fighting this as unfair/constructive dismissal..

Hello Anne - have you had legal advice on the employment law situation? Unfair and constructive dismissal are quite different things, and it's a complicated area of law.
...much enquiry having been made concerning a gentleman, who had quitted a company where Johnson was, and no information being obtained; at last Johnson observed, that 'he did not care to speak ill of any man behind his back, but he believed the gentleman was an attorney'.
  • 3)Mental illness although covered by the Disability Discrimination act, is still seen as a leg pull as they dont see a crutch, plaster or loads of collapsed veins theres nothing wrong with you.

While of course mental illness is covered by the DDA, the recent House of Lords case of Lewisham v Malcolm [2008] UKHL 43 greatly reduces the protection in housing terms for all disability.

  • hi Anne, not sure if this helps, I am housing manager for my local council, in accourdance with the Housing Act 1985/89 they have to send you a default order for the Suspended possisseion order giving you 14 days to pay the default. They should really then visit/phone showing they have made personal contact with you before requesting baliff warrant. Before requesting the stay hearing with the court (which you will no doubt be granted 99% of judges give 1st stay with offer to pay anyway) (the N244 described above) I would contact the council and ask for district/senior housing manager and explain that you have paid in advance and there has also been no default notice or personal contact. tell them if they don't cancel warrant (don't let them tell you they can't they most certainly CAN) you will apply for the stay and ask the judge to award you costs for all the time wasting as it is their error. if you want any more help let me know this is the only thing in the world I am an expert on!!! (although I am on the other side normally boo hiss) but i always help my people!
You don't need a solicitor to do a stay hearing contact shelter or CAB for free advice/representation.

  • Marshmallow thanks

I just received the bailiff on the doorstep from Ms R , I shall see what Monday brings and what the local councillor achieves...Im meeting the sister of the lady who died another Ms R victim tommorow as well, she just wants someone to talk to who has been through it as well...not sure what to say but I remember the kind folk who were around when my sister died so will be quite an emotive meeting I think.

Community Legal Services have been dealing with my boss, thats another tale of woe...but Im glad not to be working there anymore at the moment, hes another bully him and Ms R should get married there like two peas in a pod then they can growl and howl at each other :D:D:D:p:p .

Been a busy but beautiful day...in the wider picture of life Ive lost one person close and have two new lives to watch grow and develop so all in all I think him up above:A is doing his best, even the bad days are few and far between so when Ive sorted Ms R out and my old employer me and OH might get married and I can look back on the last couple years and think Ive dont it~~~ Ive survived and come through it all a much wiser and kinder person.

Will post tommorow when I hear whats happened with councillors visit to the Housing Dept..should be interesting if nothing else.

Im going to have an early night, take care folks night
