  • Hi Annes,

    Think the rent arrears / suspended possession order issue in bankruptcy all stems from a case held at Harlow County Court in 2006 invloving Harlow District Council & another.

    It is an area that has caused confusion with some other Local Authorities and tenants involved with bankruptcies and can be misunderstood.

    For anyone considering bankruptcy with rent arrears / suspended possession it is an area you must get advice on before you go ahead with bankruptcy.

    I think the OP here has raised a very good point and perhaps there are others on here who have further info or some link to the info coming out of the hearing at Harlow County Court.

    DepthCharge I agree, but anne's issue is that although she has kept to the agreed payment of £5 Per week to clear the arrears, and has receipts to prove so, the council have gone ahead with the PO without good reason.

    Wonder if Annes in the Cells, for GBH on a Rotweiller!!!!!

    We are in whats called the "Mop up" phase, mainly they have run out of money and do the bare minimum. The standard of work from the sub contractors has been shoddy. I am no builder but I have done a great job going around fixing there bodges. It has taken two days to repair the second leak on the sink. Theres a letter going to the CEO about there level of service, he can file it with the one about his staff lying to me. :rotfl:

    Bloody council:mad: :mad: apparantley the eviction order stands, like hell it does, my payments are up to date and they are in for one helluva fight...it took em 9 months to evict the drug selling twerps upstairs so why am I on a fast track 28 day chuck me out on the street one, they can go to hell. I will appeal as receptionist whispered to me as this would delay them somewhat, comes to bloody something when there own receptionist said your kidding me...

    This has gotten personal now..this is the same lot that refused me paying my sisters arrears off till it went to court till it was too late.and she killed herself.

    Yes Ive an axe to grind...but it will be ground legally , Im away to start searching for this Harlow case mentioned above....

    I will appeal, the receptionist said I would have my say in court and with my receipts etc it didnt sound like they had any reason to issue an eviction order...fingers crossed

    A lot of solicitors offer a free half hour, and as you are on benefits anyway you should be entitled to legal aid. Let them come down on the tits like a ton of bricks.

    Hi Shadowdragon,

    Yes Im with you, I was just responding to points made in Annes second and third posts here.

    With regards to the eviction warrant from what she has told us it is a disgrace that it has been issued, wonder what the outcome will be.

    If she gets no joy she will need to send in a N244 form and request a hearing at the court involved asking for the warrant to be suspended and let the District Judge decide.

    If there has been no missed payments and she takes evidence to prove this then the council rep may find themselves at the wrong end of the DJs wrath.

    Go get em annie, and make sure you fill in the forms and get to the solicitor like Skylight said.

    As Depthcharge said look into the N244 and request a hearing.

    Dont let them get away with it.
