Council/Posession Order and Me

A Long Rant.

Howdy

Prior to going BR on 21/8/2008 I was suffering from depression later diagnosed as Bi Polar, and had taken sick leave off work supported by a medical note..later got the sack and am fighting this as unfair/constructive dismissal..

I hid my head in the sand due this depression and just didnt pay my rent, and ignored councils attempts to help me, so they had to go for a posession order which was granted in June, I went to court and told my side and the judge gave council posession order, suspended as long as I paid £5.00 per week off the arrears, when arrears are paid off then posession order is no longer valid. OR has allowed this £5.00 to be paid and I also have full HB and C/Tax Benefit, and this arrears payment is 4 weeks payment in advance..

This morning there was a bang on my door, so I answered it...lo and behold my handsome bailiff was standing there and handed me an eviction order that I have to give up posession of said flat in 28 days:eek: :eek: :eek: :eek: the posession order states that I have not kept up with my agreed payments of the arrears and have broken the payment agreement hence the eviction notice.:mad: :mad: :mad: :mad: ...

So panicking I get out all my receipts for payments and yes I have paid in advance so what the hell are they playing at..?????

On phone to council...speaks to the Ms Rottweiller the housing lady and shes adamant that oh yes Annie you are being evicted...like hell Ms R.

On phone to OR...they cant help this is a council matter and then they start saying if you have not paid the £5.00 youve been allocated for rent arrears then we will review your SOA...naff off idiots... I phoned up for help not criticism.

I have receipts and rent statements showing these payments are up to date..:mad: :mad: :mad: :mad: :mad:

Daft thing is if I had moved in with OH my rent arrears would have been squashed in BR petition and they would have gotten nowt:mad: but as I want to keep my independance a bit longer I have stuck to the agreement rigidley and paid and been a g:mad: ood girl then this, my god Im fuming, Im much stronger than I was a few months ago when something like this would have pushed me over the edge.

They did this to my sister and she couldnt take it, so Im donning my imaginary guns and going up to that council in a moment and boy am I going to be shooting but verbally, teeth grinding with good manners first and foremost and Im going to stick that posession order where the sun dont shine...complete with receipts... plus I have Tax Credits folk dancing in the background waving an overpayment notice at me.....I just hope my BR number gives me some protection.


Will post later, this is one battle where I have not done anything wrong, done it all by the rules, paid and still get treated like scum well this person isnt taking this lying down...wheres me posession order and keys..speak laters

    you go and kick there !!!! Anne. How come there system didnt show the payments? didnt you get a letter saying you had missed payments?

    It must be an administration error!!!!

    Ive had no letters re missed payments just bailiff on doorstep this morning..

    Administrative error be damned, what if this had gone to someone in a bad predicament and the end of there thether, this needs stopping and facts checking before they make someone do something stupid like my sister did.

    At my sisters inquest the coroner made it loud and plain that local council had played there part in there unfeeling attitude towards my sister, and the local paper ran a story on it and there letters page in the paper and online was full of others being harassed and tormented by this particular councils arears dept.

    Yes I know I owe money and yes I have gone bankrupt and yes I feel ashamed but I dont need them rubbing my nose in it when Ive abided by the rules and am paying my dues.

    I have just dug out the press cuttings and her coroners report and her last letter to me, in which she fully documented in detail why she committed suicide, damn em....

    Rant over Shadow :D:D am of to put a few noses out of joint noo Im not gonna bop them on the nose just wave my payment receipts at them :rotfl: :rotfl:

    ho I agree with you 100% they should be more compasionate. I am always complaining to/about the council. Fortunatley not about arrears, but repairs/communication ect.

    May I ask why your arrears were not included in your BC? I have read BC wipes council housing arrears out. Clean slate and all that?

    The posession order was granted on June 18th 2008 my BR date was 21st August 2008 and as the posession order was already in full swing but suspended I was told by OR and CAB that if I did not keep to the agreed £5.00 per week arrangement I could be evicted.I get full Housing Benefit and Council Tax but still have to pay off these arrears if I want a roof over my head.

    I cited that paying these arrears off would mean I was making preferential payments to a debtor but the examiner who gave me the OR interview last week said that was not the case :confused: and they had allowed me to pay these arrears of as per agreement to keep a roof over my head,:confused::confused: .

    Im sure there wrong and £5.00 from my £60.50p per week Income Support along with a flat rate £5.00 per week CSA payment and £5.00 for a court fine (No TV Licence) leaves me £45.00 to pay water rates/ electric/gas/contents insurance/tv licence and for food and clothes.
    Its tight but I manage,,,,just..thats why I know my payments are up to date.

    If it wasnt for Freecycle and some fantastic friends Id be on my uppers at the moment Im coping..my sisters do regular relief shop for me thank god and I stay at OHs some weekends...Im not pleading poverty, I manage, I will be debt free as my rent arrears will be paid as will court fine and if taxcredits keep off my back I will be earning after my discharge..

    Might just look into why Im paying these arrears off maybe theres some crossed wired here as I thought BR cleared all debts except with a couple of exceptions ...right am of to council and spoil there last hour of the day:D Anne

    Haaa makes sense, I still think that the PO should ahve been squashed and arrears included in BR though.

    Ho well nevermind whats done is done, you get down there and sort it out.

    If you need a team of BRs to sit outside the council offices with placards, you know where to come.

    I'm gonna swear. Boillocks. Dad used to work in similar department to Ms Rottweiller (for another council) and he would get cross at the powers that be who refused to kick out those that owed £1000's but picked on those smaller people. He left in the end.

    Get the details of your local councillor and get round there tonight as well. And details of your local government ombudman and write to them and your MP as well. Not sure I would want to take it to the papers though.

    If its council accommodation, then kicking out a vulnerable person (on Income Support, depressed and bankrupt so very vulnerable) is a waste of time as they have a duty to help vulnerable people.

    Council Suck imo, its not just the likes of anne here, its the fact they let idiots drive on the grass with minimotos and quad bikes, they let the guy round the corner use his front and back garden as a scrapyard. They dont keep the roads clean and tidy. ~When you complain about the broken bottles in the road after the drunken Tw@ts are on there way home at 2am on a sat and sun morning, and they do nothing about it. But if I missed a rent payment "BOOM" there suddenly super efficient.

    Tell me about it. We have a 2 bed and been on a waiting list for several years. Need a place twice the size but cannot help. But the guy who "lives" opposite has that 4-bed council house we need, but he purchased privately and lives elsewhere. He sub-lets to 15odd Poles and the council are doing nothing - cos the rent is paid to them on time I guess. The same council started court proceedings when MIL was 3 days late with that months installment of council tax - which they weren't allowed to do! The same council I argued with over my overpayment of benefit (which I was actually entitled too!) and they wouldn't include it in my BR. Do you think there is a special Idiots Guide to Being a Council Worker that we don't know about? :confused:

    How about this one then

    The sewage pipe got blocked and flooded about 5 houses including mine, but the council are so inept I just cleaned my garden up myself as I was sick of telephoning the council.

    Foolishly because Waterrates are included in the rent I did everything through the council, after the fact I find out my neighbours all received £75 for inconveinience from the water board, I telephoned them with the "Wheres mine" question, and as I didnt phone the water board direct I wasnt entitled to it. I was not happy not only did I have to clean up the waste in my garden I lost out on a good will payment!!!

    Dont even get me started on the new bathroom and kitchen we have just had installed by the council (I new it wasnt going to go well when the workers turned up and tied there horses to the fence!!!)
