    So much for their "help" on here. They don't even sort out their own mistakes for the handful they publicly choose to suggest they will.

    1) If the letter previously put in your post to them is what you refer to as your LBA, it doesn't really qualify. See the relevant post for LBA in my guide. It must go to the registered address (you should be able to find that on their website and it will then be Carphone Warehouse Trading as.... at Portman Square. You must state clearly the action you will take if they don't fulfil their obligation under the contract you signed up to and PAY you what is correctly overdue in 7 (or 10) days (i.e. commence legal procedings and claim for court costs and stautory interest etc).

    is not the LBA.

    Firstly, I have sent the LBA to the following address (the same address as printed on these cashback forms):

    OneStopPhoneShop Cashback Claims

    Loughborough
    LE11 9EL

    And here is the LBA which I have sent off by recorded delivery on 14 October 2008 (that LBA reached OneStopPhoneShop on 17 October 2008 according to Royal Mail Tracking):
    Dear Sir or Madam;

    Hereby I am issuing you this Letter Before Action notice.

    I refer to my previous letters from 22 September 2008 (Royal Mail Tracking Number DV123456789GB) and 2 October 2008 (Royal Mail Tracking Number DV987654321GB) in relation to my claim for the second installment of the abovementioned Cheque Back Offer.

    You have wrongly rejected my correct claims (your letters from 25 September 2008 and 7 October 2008). I can prove that I have sent you all relevant documents in the correct time frame and that I have followed strictly your Cashback rules.

    Now this letter is my final attempt to claim my Cashback for the second installment.
    I have once again attached the bill from 15 August 2008 and the cashback form.

    If I do not receive a cheque of the amount of £30.00 for the second installment by 24 October 2008, I will have no alternative but to commence court proceedings against you without further notice.

    If it is necessary to pursue this course of action, please note I will also pursue interest and incidental costs.

    This letter is sent to you by recorded delivery.

    That is fine. Though as you didn't mention their fundamental breach of contract, then you may be on sticky ground just introducing it in your particulars of claim. If you want to pursue them for the full amount because of the fundamental breach you need to first give them the chance to pay you the full amount.

    Use the physical address in my post above for the MCOL (don't use the po box address)

    If you decide to sue, then there is no need to waste any time/money on answering the last letter you got from them.

    Let the MCOL take its course, and see how they react to it.

    and to thank everyone who helped me with this - especially mobilejunkie.

    I shall report on this so others can benefit from it:
    I sent off a claim to Money Claim Online which was really easy to do!
    The inital court cost was £25.00.

    Recall that e2save stuipdly wrote to me saying
    I realise this may not the decision which you had hoped for and I apologise that we are unable to offer further flexibility with our terms and conditions. I can confirm that this is the final decision regarding the month 4 claim and this will not be overturned. I am sorry that we are unable to offer a favourable resolutin on this occasion.
    After sending off my claim to the court (I think just a couple of days later) I received the following email

    Dear Ms XYZ
    I am contacting you regarding court claim 1AB23456 regarding your cash back.
    I would like to make the following settlement offer.
    E2save will pay your first cash back claim of £30.00 plus court costs of £25.00. The full amount would be £55.00 this is the full amount of your court claim.
    Please note this is not an admission of liability.

    Please confirm acceptance of this offer to close the court claim by either email at [EMAIL="emmah@e2save.com"]emmah@e2save.com[/EMAIL] or on the number below.

    Oh, wonder! This is pretty much contrary to what they wrote to me earlier.

    Anyway, I've got the cheque and banked it.

    I shall never again deal with this crappy company called E2save, OneStopPhoneShop and carphonewarehouse or whatever they call themselves. :mad:
