Go to Phones4u or their other site, Mobiles2yourdoor. Their deals are FAR better anyway and I find them (CURRENTLY) exccellent to deal with. However, make certain you understand ANY cashback deal and dealer thoroughly AND follow closely throughout the contract. E2Save WERE better than this company, but now they are complete and utter liars and will do anything to avoid paying once they "choose" a claim. They also severly mislead people from the very start, constantly CHANGE the t&c you sign up to (if you let them) and even the claim dates - which often (if not usually) ignore the ones you signed up to anyway. Of course, if you need a particular phone it may not be so clear-cut - but unless you really know what you're doing and are prepared to stay on top of it all throughout - AND are preapred to sue - don't even think about E2Save or their other site, Onestopphoneshop.0

I agree with mobilejunkie - e2save are a bunch of liars - if you send cashback bills without them being recorded delivery/or you lose the delivery note, they will NOT pay out the cashback by claiming that 'they never received it'.0

Actually I still send the odd one non-recorded; but only when I have a back-up plan. Got one paid recently and promptly - but definitely wouldn't recommend doing it that way! What is unacceptable is that once claiming non-receipt they only change they then pretend to have "found" it IF people can quote rc numbers which tracked - then they make them wait just as long for their cheques as if from day one. Delivery note isn't an issue; only the record from RM which can often be obtained even when it ends up in limbo "being processed". However, this is all just one of a number of dishonest attempts to ensure the number of successful claims decreases without being SO heavy-handed they end up in real trouble. With their current abysmal offers I'm actually surprised that people still order from them at all!0

I've just had a look on the Three website at the deal you want above. Direct through 3 the price plan is only £25, you'd get £62.50 from Quidco and if you include a friend's 3 mobile number when you order you will also get £30 each.
Total cost with E2Save = £370
Direct with 3 (including the above) = £357.50
I'd go the direct route, hope this helps.

I hope you can help me further. After sending off my letter before action I have received the following letter from OneStopPhoneShop (I was away and just got back to read that annoying letter). I state it here for now and will quote from it in my next post to comment and ask questions:Dear Ms XY,
Thank you for your letter to our Customer Support Team regarding your 4 month cashback claim for
mobile number 0123456789. I am dissappointed to hear that you have experienced difficulties with
your claim and I apologise for any inconvenience caused.
For the month 4 claim we needed to receive the bill dated the 15th August within 60 days of the
date on the bill as per the information supplied in the paperwork that was sent to you with the
SIM card.
The claim was first received on the 25th September however the bill received was dated the 15
September and was therefore the wrong bill. A rejection letter was sent to you to explain this.
You then contacted our Customer Service Team on the 7th October and spoke to Mr NOTHELPFUL who
advised you that we needed the August bill for month 4 and that we needed to receive it within
60 days of the date on the bill.
On the 7th October we again received your claim and again this contained the September bill.
The claim was rejected and we wrote to you to inform you that the incorrect information had
been received.
The August bill was then received by us on the 20th October 2008. By this time the claim had
expired as this was over 60 days from the bill date. As per the terms, a letter was sent to
you explaining the rejection.
As we have not received the required documentation within your claim period we are unable to
award with your cashback in this case. Although I appreciate that you feel that this claim is
die to you as part of your original contract, I must advise that there are strict guidelines
that must be met in order for your claim to be honoured and in this circumstance these guidelines
have not been met.
The guidelines surrounding your "Cashback" claims are sent to you with your phone on connecting
to the contract; and clearly state the requirements in order to ensure you have sufficient
information to make your claims correctly. This information is also available on our website
and through contacting our dedicated team of Customer Service Advisers.
I realise this may not the decision which you had hoped for and I apologise that we are unable
to offer further flexibility with our terms and conditions. I can confirm that this is the
final decision regarding the month 4 claim and this will not be overturned. I am sorry that
we are unable to offer a favourable resolutin on this occasion.
You are still able to claim the month 6 cashback for mobile number 0123456789. For this claim
we need to receive the October 2008 bill within 60 days of the bill date. The bill needs to
show your mobile number, tariff, bill date, name and address and that there is no outstanding
balance. We recommend that claims are sent recorded post to Cashback Claims, Admail ADM 4118,
Loughborough, LE11 1YX.
I hope the information in this letter is useful however if you have any questions regarding
this letter please do not hesitate to contact our Customer Service Team on 0871 522 3401 quoting
your unique customer reference number, or for cash back queries please call 0871 522 3404 and
we will be more than happy to help you.

This letter makes no difference to your case regarding your mcol. (Apart from confirming to you that the only way you are going to ever see your money is to proceed with it.)
Presumably they have now ignored your lba (ie they have not carried out the action you requested to prevent you taking further action.)
Your option now is to issue the summons or give up.

So much for their "help" on here. They don't even sort out their own mistakes for the handful they publicly choose to suggest they will.
1) If the letter previously put in your post to them is what you refer to as your LBA, it doesn't really qualify. See the relevant post for LBA in my guide. It must go to the registered address (you should be able to find that on their website and it will then be Carphone Warehouse Trading as.... at Portman Square. You must state clearly the action you will take if they don't fulfil their obligation under the contract you signed up to and PAY you what is correctly overdue in 7 (or 10) days (i.e. commence legal procedings and claim for court costs and stautory interest etc).
2) There is no need to send this recorded delivery.
3) They won't pay and may not even reply (though they may do since your case looks clear-cut from what I've read and you seem to be able to prove it easily enough).
4) You must resign yourself to suing them. They are most unlikely to pay you otherwise. You must therefore start reading back over all the other threads on this disreputable, dishonest company so that you know how to proceed and what to expect.0 -

For general info, you no longer need to find out a defendant's registered address to issue lbas/mcols.You must provide an address, including postcode which is either the company’s registered office or any place of business in England and Wales that has real or the most connection with the claim e.g. shop where goods were bought.
In this case, the osps Loughborough address is perfectly ok.
