Plusnet - change in T&C after i've joined up!

    Most of us accept changes to T & Cs but not when it affects you financially and when it affects you financially there is always a get out clause. All T & Cs would have this as standard otherwise the companies would have a lot of court battles due to pepole being "financially disadvantaged".

    I am really annoyed at this. The point I was making is that any change in the T&Cs can be made and I am held over a (£40 + cost of router) barrel to accept them.
    I believe also, as you implied, that Plusnet is owned by BT

    Yeah, we're owned by BT Retail. The charge is coming from Wholesale, and they're also charging BT Retail.

    Hi James,
    I too am looking to leave madasafish over the changes.
    in my case , I have been with madasafish for about 2 years now,
    this january I asked for a mac code to leave and customer service made me a reduced price offer.

    so there is no activation or hardware costs relevant

    so why are the indian ( read bolshy ) customer services
    trying to claim I would owe hardware and setup costs to leave .

    Your terms claim to require the return of activation and hardware costs
    neither apply to me.

    As far as madasafish customers are concerned, this detrimental change to the ts + cs means any of them wanting to leave (for any reason) can now do so without paying any early termination fees.

    To use this get out you must give them notice within 30 days of being informed of the increase.

    The relevant condition is 10.8:
    10.6 You may terminate this Agreement within the first 12 months after the Commencement Date if you agree to pay us all the costs that we have incurred in setting up your Broadband Service. This will include an installation fee of £40.96. You must also pay the cessation charge detailed in 10.7, and the full retail price for any free or subsidised hardware that you ordered from us.
    10.7 If you terminate this Agreement at any time, and choose not to transfer your Broadband Service using a MAC code, you will be required to pay a cessation (cancellation) fee of £20.00 to remove the Broadband Service from your telephone line. This charge is applied to us by BT.
    10.8 If we have made a change which is to your material detriment, you will not have to pay the charges set out in paragraph 10.6 above if you decide to end your Agreement early. However, once we have told you about such a change, you must let us know that you want to end the Agreement within thirty days.

    The fact that madasafish has the 10.6 clause suggests that not having it may mean that Plusnet has an unfair contract. As I previously pointed out it is quite an expensive barrel they have their customers over.

    It isn't "unfair", just different.

    Plusnet are acting in line with their ts +cs.

    Unfair contracts cannot be enforced, but testing the Plusnet one in court over this £20 is just not viable.

    They, of course, could take a bold step and make another change to their ts + cs and come into line with madasafish - which seems to be the same firm in all senses. (Both are really BT under other names, and they seem to use the same staff - certainly on here they do).

    Lets see if this suggestion gets any response!

    maybe they meant to say that you need to pay the remainder of your new contract - they wouldn't have reduced your subscription if you didn't agree into staying for another 12 months
