    They did not take the case because her car is still driveable and so they cant make money from the hire car company. I am well able to write to his insurance company myself. I have taken on board what people have said (she rang her insurers and told them of the crash, told the police what happened when they came yesterday etc) and you are wrong to say I haven't. I am not a troll but a human being and it is a shame there are not a few more humans on here. If I was trying to hide things I would not have said the police had been would I ??

    I meant I had been honest about the police. We called the insurers today and they are sending an inspector to look at the car and have arranged a hire car whilst it is the garage.

    No, I'm not. I'll agree that that is unduly harsh – I believe that the punishment should fit the crime, and incarceration is not befitting of someone driving with no insurance (unless of course it's a repeat offence or coupled with something like driving under the influence).

    My comment was in reference to posters stating simple facts, e.g., that the daughter stands to get an IN10 conviction, and yet the OP jumped down their throats accusing them of "wanting her daughter to get done for this". :confused:

    What she consistently fails to understand is that it's not what I want, or you want, or what the OP (or her daughter) wants – it's the law. Her daughter broke the law, for which the punishment is a possible fine and an IN10 conviction. It doesn't matter if that's what you or I believe is fair or just – it's what happens! You can't pick and choose what laws you want to abide by!

    And I bet if some young boy racer driving without insurance had hit the OP's daughter's car, the OP would NOT be bitterly saying "oh you all just want to see this boy go down for it", more likely than not she would be saying EXACTLY what the majority of posters are saying here about her daughter.

    For every action there is a consequence, and the consequence of driving with no insurance is a fine and a conviction. Is that so hard to understand?!

    I wish everyone would let it go for a while. I will post again after Monday when the insurers come and after we hear from the court. I wish I could get an insight into some of the perfect lives some people on here have!!!

    I doubt anyone on here has a perfect life, but most people on here who own a car know their legal responsibilities. There are no excuses for driving without insurance.

    None? Absolutely none? Whether through quite genuine error, or due to a mistake by someone else, or a misunderstanding, or perhaps being deliberately misled by someone else. Are there no excuses at all?

    I do hope that those who preside over these matters at magistrates' courts do so with a little more objectivity than I've seen on this thread.

    No Insurance is the only "ABSOLUTE" offence in English Law. This means you are actually deemed guilty unless you can prove your innocence - ie you produce proof of insurance. Overlooking renewals, not receiving renewal notices etc etc don't count but may be taken into mitigation when fines are imposed but penalty points are mandatory if it gets to court. There may be some circumstances where a Police Officer may elect not to send a file for prosecution but that is at his discretion.
