Yes, I would imagine that they would be told that at the time. However, there may be issues that need monitoring - eg my car just passed its MOT but needs a new tyre - that is clearly written on the form.

The fact remains - he has the cert, she wants to see it, he is being difficult about sending it. How hard is that task for a business person?

She was told at the time that the guy doing the check couldn't get properly in to check the boiler cos a cupboard has been built round about it.

As far as he could check then things seemed fine but we now want to know what the safety report actually said. If there were recommendations from the gas company that something needs to be done? Or if the gas company are satisfied that what he did manage to look at is considered a full check or not?

When she moved in, she was told that the boiler was brand new, the guy that done the safety check, said that it is probably about 3 years old. Lots of conflicting stories about the boiler, so she wants to see the safety certificate and is quite entitled to know she is safe in the home she is paying a bomb for!

This type of LA deserves to be driven out of business. You are *entitled* to know that the gas checks have been done properly and to see that certificate.

No matter how many years he has been in the business he does not have an option on this one, he really doesn't. The LA is an absolute fool: he either does *not *know the law or knows it and is happy to flout it.

It is a legal requirement that you (a) see a copy of the certificate before you sign the contract or (b) that there is a copy at the property. The LL has to arrange an annual gas safety check and has to keep copies of the previous 2 years certificates. When the cert is issued there is a LL copy and a T copy. the check & the cert have to be dealt with only by a CORGI reg gas fitter/plumber.

Here is what you need for info : http://www.hse.gov.uk/pubns/indg285.pdf

If he still refuses then report him to the HSE and to the Env Health Officer ( & the Tenancy Relations Offcier ) at your local Council. He is committing a criminal offence and can be taken to the Mags Court & fined several thousand quid.

Get yourself an audible carbon monoxide alarm (tenner from B&Q) in the meantime but don't let him get away with this one. The tenancy relations officer can liaise with the LL if necessary.

There is an electrical inspection coming out about now too isn't there, perhaps this LA will keep them both on file

 Sorry N79 - yes, that happens but anyone letting property is personally responsible for ensuring that a copy is there on the premises for the current tenant.

Professional LLs have a folder that all this sort of stuff goes into and checking that out is part of the rounds when re-letting. Even a 10 year old could sort that one out.

If the LA can't sort simple paperwork then there's probably not much hope that he can manage much else.

I agree, isn't it simple just to provide a folder with all the necessary documentation in, including all the instructions for boiler, appliances, tenancy agreement etc

Why do LA find everything to be such a big deal when most of it is just routine

Have spoken to HSE, they have sent a letter to the LA and aparantly by law they have to reply within 10 working days (not that they care much for the law) so we shall see what happens now

    And it continues.

I phoned the companies that you phone to find out who your suppliers are for gas and electricity but nobody can tell me. I am 42L (left) and my neighbour is 42R (right) but every company only has one 42! I have this problem on websites I am registering for too (when they search your address by postcode), they never have anything but 42!

I wish I'd never moved into this insane flat!

Just out of interest, I ask again, what did the guy say?
As for the age of the boiler, it is not important, the boiler itself is unlikely to be an issue, rather the installation of it and the supply of gas to it.

You seemed to discuss all manner of things, yet still didn't ask if the installation was safe, it's really simple, if it wasn't then he should have stuck warnings on it, if it was then a certificate should have been issued.

I quite agree that the easiest course of action would be to just present a copy of the certificate.

There you go Captain Mainwaring, all in bold and even underlined for you. I like to give to Charity (Help the Aged seems to be the one for today). So to reitterate just for you, she did ask and was told that as far as he could see things were fine, but he couldn't check everything because there is a cupboard built round the boiler. ;)

And yes the age of the boiler does matter. She was told it was a new boiler fitted, and that was why she didn't receive the safety check before she moved into the flat (because if it's a new boiler they aren't legally obliged to have a safety check). Now the guy that came out to do the safety check after she moved in has told her the boiler is about 3 years old. So legally she should have been shown the safety certificate before moving in or it should have been left for her for when she did move in.

Hope you have got the gist of it now. ;)

Threads on the house board always seem to attract people looking for an argument.

Have now found out that British Gas supply my electricity so was trying to phone them to see if they supply my gas too but my phone died

Will give them a call later on when it is charged again.
