Thank you for your advice today, its been really helpful. I feel a lot better than I did 3 or 4 hours ago..... Shall I post my revised soa allowing for rent and not mortgage and debt. Bottom line is, if mobile has to go and food bills need to cut then so be it... Just one more question - should i write to creditors to explain that i can't afford the minimum payments, at least for now?

Yes post a revised SOA it will show that you can manage after BR (and i repeat if thats what you choose) and what surplus will be left if any so we can say if you may get an IPA

Telling creditors is not always a good move as that just usually ups the pressure to try get some money out of you before you go BR

But that is not important, lets see if BR is the most viable answer for you first Your revised SOA will help confirm
    if it is too

  • I agree with BAAB and as a plus you can use that information IF/When you go BC for your forms. So it wont be a wasted exercise.

You say your mother lives with you and yet you have not put in an amount from her? Does she pay for her own food? if not then I think it will be questioned why she is not paying you anything at all.

Have you had letters from your creditors yet, or phone calls? how many have you not paid this month or months

  • ok will sort that and send it next.

My mum pays for the Virgin/NTL -tv, phone, internet. She does get my niece to do a bit of shopping, but its just really bits and pieces she fancies. I've asked her to stop that so I can get a better reflection of what needs to be spent on food/household. (Plus I gather niece wasn't being entirely honest about the spending but that's another story!!)

Rylynn, i haven't had any letters from any of them because iv not missed any payments yet - although because i've now cut up cards and not yet sure what's going on with OH, then i think this month might be the first that i have to do it. That bothers me a lot - even tho i haven't missed anything and haven't got anyone after me, i get minor panic attacks when i leave the house now - i don't know if i can cope when it's all happening for real.

You will have a while before it gets to anything serious if you stopped the DDs now. They will harrass you but cant do anything (bailiffs ect) until its been to court. Loads have been through it here and its all the same they ring you constantly ect but you just need to keep your head down and ride it out until the BC court date. But dont worry about that until it happens as you can come on here and get support and advice about it when it happens.

Okay, I am in the same boat as you as my mother pays for my broadband and NTL, but to be honest she still gives me something each month, and I was told the OR will expect her to, even though she is 74. Anyone else got any thoughts on this? or have a similar position.

Okay try to stop getting panic attacks by telling yourself you are dealing with this as you are, and that is a step in the right direction, and you have to keep telling yourself so, you have no longer got your head in the sand and you have people here who will help and give you support, but we cannot tell you what to do, you have to make that decision yourself.

  • You've all been really helpful thank you. I just have one more question - from some of the posts I've read, CCCS make an appointment to phone - so do i contact them by phone or email (sorry to be so dull)? and do i need to have my exact figures in front of me when i speak to them?

Rylynn, was your mum affected in any way by your bankruptcy, ie pensions or anything?
  • Rubie-blu. due to our situation, my OH had to stop paying her creditors in January. (im already BR)

We are now in september and we only just recieved a court summons at the end of august, which incedently i can defend, and maybe get thrown out, but even if i cant im estimating that we have into the new year before a judgement can be made so dont panic re your unsecured lenders, you have loads of time, the only one to watch is your mortgage lender

If you need time we can help on that front too regards the unsecured ones

I rang CCCS myself so not sure if you can arreange a call by email

I cant see why it should affect your Mum but will let Rylynn answer that to be certain

  • I rang CCCS and they took some basic details and booked me an apointment wtih an advisor 3 weeks later (yes they have a long waiting list). Meanwhile they sent me a pack though the post which tells you about them and a SOA form to complete (which I didnt need as I had a spreadsheet with all the details on anyway).

You then have the interview and they go through your SOA and give you recommendations.
