    It's quite an experience the first time, isn't it.

    I did it (against Abbey), and I could actually feel my heart beating faster - I walked into the kitchen with a sly grin on my face and my wife said "What have you just done?"

    It all worked out in the end, of course. And the thing to remember is you are RIGHT - it is the bank that is legally WRONG - and they know it.

    I would imagine (as has become Abbeys form) that at the time you receive the Court Allocation Questionnaire, they will offer you half. If you refuse, they will settle in full.

    The will intimate that they should be due to charge 'something' - this is true, they are allowed to charge something - just not in excess of their costs - I never claim for the extra interest that they charge - I see this as a fair wayof covering their costs. Of course, they have also had the 'lend' of your money for 6 years too - an interest free loan for 6 years must surely contribute in some way to covering the costs that they are legally entitled to. With that in mind - I would always hold out for a full settlement.

    Also, don't let them bully you into a confidentiality clause - YOU ARE SUING THEM - not the other way around - you call the shots thank you very much.

    If they ask for confidentiality, then say yes - at a price; say 50k to start with.
  • Oh Yes - I like that! After reading all the notes on here i absolutley know im right and i will be holding out for the full amount, I cant wait to walk in the branch (they all know me by now, being trying to get the money back for almost a year now) and withdraw all of MY money! Going to pay off overdraft and credit card. had almost given up when i found this site.

    at the point of giving up i considered negotiating and offering them a very small amount per charge, then when i saw all the support on here i just thought, its my money and their fault i ended up with charges in the first place so am thrilled to be claiming for the full amount.

    Didnt know about confidentiality clause, thanks.

    Hmmm....NTL may be another.

    The problem is, because the domain is not on the same server that the email is generated from, a reverse DNS is not possible; therefore, some ISP's think that the confirmation email is spam and don't allow it.

    The only way round it (at the moment - I'm working on it) is to get a hotmail account or similar and register with that address.

    Registration is working: we've had about 10-12 new registrations today already - the bl**dy site was down this morning due to a 'migration' issue - we've just upgraded the server etc...

    pink_fairy - don't close the account (unless they force you to - in which case they would be in breach of the Banking Code (not worth using as toilet paper in my opinion). However, there is (at the moment) nothing that can be done if they do close it.

    It's best to keep it open, maybe a pound in credit. It's getting harder and harder to get a current account in the UK at the moment - it may come in usefull in future years.

    Or, indeed, if you continue to use it and incur more charges - your threat of court action may well be taken more seriously next time - they will KNOW you mean it and will not have to "test the water" to see how far you are prepared to take it!
  • right i have tried with hotmail, think i read on here that ntl have a new spam reader that even thinks emails from ntl are spam!

    i`ve tried a hotmail address to register still no luck.
