Old Debt? Mackenzie Hall

  • Hello, recieved a letter claiming i owe debt. I have checked my credit file and discovered Mackenzie Hall has performed an unclassifed search... Whoopie... If i do owe any debt (not admitting it as to drunk form uni days to remember) 8 years is a little late to be asking for it. Anyway, I took the liberty of emailing the following directors to save on postage!     I would point out that under the Limitation Act 1980 Section 5 “an action founded on simple contract shall not be brought after the expiration of six years from the date on which the cause of action accrued.”

    No correspondence/payment/acknowledgement of this debt has been made/received over past six years and no further acknowledgement or payment has been received or made since that time. Unless you can provide evidence of payment or written contact from me in the relevant period under Section 5 of the Limitation Act, I suggest that you are not qualified to take any action against me to recover the alleged amount claimed.


    Furthermore, the OFT Debt Collection Guidance states that "continuing to press for payment after a debtor has stated that they will not be paying a debt because it is statue barred could amount to harassment contrary to section 40 (1) of the Administration of Justice Act 1970". And will be reported to the police!



    I used to be a Debt collector when i finished Uni, Its a carp job, long hours with little reward (Social anyway) thats why they are rude. They have little in fact no rights unless they go to court which is a drawn out process. Keep a diairy of all calls, letters and inform them that all future calls will be recorded. and sign up for Equifax Credit Watch to monitor any searches, defaults etc. FACT. Debt collectors manipulate the week just like bullies. (Thats why i left) there not clever, and what they do is harras. if the debt was unsecured they have no hope!

    Take Care and don't forget, email the bosses, and avoid talking to the donkey on the phone.

    I am not excusing myself for the foolish antics of a university student but am wondering to myself if Mackenzie Hall can chase up a debt from that long ago.

    My nest step was goign to be to get a copy of my credit record but I am not sure if it would be worth it given that it holds info for 6 years only.

    I guess I am looking for advice and to find out if anyone has had dealing with Mackenzie Hall before.. (I have done a search but found nothing in the forum).

    Help greatly appreciated.

  • Hi, if in doubt, email and tell them to get F**KED

    Write to them telling them that all calls will be recorded for legal reasons. also request for environmental reasons, all communication by email. The following tw*ts are senior directors.

    If the debt was unsecured which it probably is and is 6+ years old they have no rights at all. check out the

  • These losers buy debt normally written off by from banks and tends to be univerity debt overdrafts etc. They threaten you with lies so you make a payment. If you aknowledge this debt with a payment they've got you even if it isn't your debt. These guys love to be emailed as it save on paper and you can straight to the top and complain about the rude donkey phoning you.

    i too received the exact tnt slip!! looks like they have sent out their latest batch of letters / slips in the vain hope that they will get some money from peope who dont know their rights.

    I got one of these today too and just thought I should search them before calling. Glad I did - lots of info and good advice on how to deal with them! Thanks - will keep an eye on the forum for any further advice, but for now I gonna IGNORE THEM! :T :T :T

    I've just googled MacKenzie Hall and your site has come up so I've now registered.

    I received a letter in the post from JB Debt Recovery in Glasgow showing MacKenzie Hall versus me (as you would in court hearings etc), except they've spelled my name incorrectly.

    I phoned them up (3 times) and apparntly this is for a debt to People's Phones - MacKenzie Hall had apparently bought the debt just as some of you have said. This was back in the days when a 'car phone' literally meant a phone bolted into the car - that's how old this is!! and I went to court over an outstanding bill. People's phone's didn't get the judgement they wanted and I settled the amount the judge said I had to. When I explained this to someone at JB (very nice girl, just doing her job - I understand that) she said I would have to provide proof that I had paid it - perhaps I could apply to the court for a copy of the judgement. Now, this is so long ago, I'm not likely to remember what the case number is to begin with so I told her that IF this is the same debt this is their problem, not mine. They have to prove that I owe it before I have to prove that I don't. I also said that if they wanted to take me to court they could and that if they did I know I would wipe the floor with them and would also ask for compensation for harrassment. She's going to get back to me once she has spoken to MacKenzie Hall.

    I seem to remember a previous letter I got a few months ago (maybe 6 months) and I think it was about the same thing. When I told them I wanted proof they said OK and I have heard nothing more. it would seem that this (and other) companies just pass debts (real or not) around to debt collection agencies to write to unsuspecting people - what if they pay because they don't know or can't remember etc?? Is this a lawful practice for these companies to undertake? Do they have a regulatory body does anyone know? :mad:

    You were quite right, missesb - you have absolutely no obligation whatsoever to prove that you have satisfied this 'alleged debt'. Mackenzie Hall are legally obliged to show proof of any 'alleged debt' which these lowlife may be attempting to pursue. The fact that they did not respond to your request of six months ago may mean that they have already committed a criminal offence.
    And in any case, if they fail to provide a true copy of the original signed consumer credit agreement, relating to the 'alleged debt', within 12 working days, they would need a court order to pursue it further.
    As for 'very nice girl - just doing her job' I'm afraid that that sort of person simply does not exist at Mackenzie Hall.
    May I suggest that you keep any further correspondence to this band of scavenging vultures in writing only - you may need it as evidence.
    I remember the type of 'carphone' that you were talking about, and would strongly suggest that this 'alleged debt' would, had it not already been satisfied through the courts, be covered under the terms of the Limitations Act, 1980, and be statute barred anyway.
    If you get any further calls from this heathen company, simply send them the 'statute barred' letter -
