  • Mac Hall are so persistent. I opened a letter from them to my late father earlier this year - curiosity got the better of me too, especially as my father had never lived at my address. I sent it back, telling them he had died (in 2000). Since then I've had 4 or 5 letters all on similar lines, culminating in one saying they would be sending their "field collectors" (makes them sound more like natural history buffs than bailiffs!) in the next 7 days unless my father paid up, as they'd had no response to their numerous letters! Thanks to this forum, I know I have nothing to worry about and will NOT waste my time and money phoning/writing to them.....I'll post on the forum should these "field collectors" actually show up. Can't say I'm not anxious about the prospect, but hopefully their threats will come to nothing...

  • On moving into my new house, a letter arrived addressed to the person who used to live here (from Mackenzie Hall), it was a final demand and I did not want bailiffs showing up at my house for someone who didn't live here, so I called them and told them where the guy was likely to be working (info from Landlord). They asked for my name and me thinking that I was being nice and doing them a favour, gave it to them.
Now, yesterday, I received a letter addressed to me from Mackenzie Hall - I called and asked them if they were sure that I owed money, as I had called previously about someone else - the guy who answered was totally unsympathetic and insisted that I owe Lloyds TSB money from 2005 - I know for a fact that I don't. I asked him to find all the details and he said to give them a couple of days and he would have the details.
So, I called back today (I know I only gave them a day) and spoke to a guy called Fraser with a really bad attitude - I asked him about the details and he said it would take 4 weeks at least!!! I asked him why the attitude and he said that all the details pointed at me owing the money - he then scarily enough told me my previous address and said that he had got this from Lloyds, I asked him why if Lloyds had that address, why couldn't they contact me themselves and he said its cos they don't trace people - I didnt think to say at the time that I had only just left this address and before 2005 had never stepped foot into the address.
I then explained that I am pregnant and my baby is due tomorrow (8th Dec) and I wanted all this sorted before it came - which is impossible. Fraser, really did not care, he wasn't helpful and I felt as though he had already formed an opinion on me before I had even called.
I have insisted on both occasions that this debt is not mine and my partner called Lloyds today and they have never heard of Mackenzie Hall.
Lloyds can't prove it to me, as I have no bank, card or loan details.
I have asked for a report from Experian - if the report comes back clear - can I send them a copy and get them off my back? - before they come back to me with any 'details' which they can dig up.
Oh yeah, they also knew my date of birth - this has worried me - but I KNOW that I do not owe Lloyds any money.

Shibby I wouldn't worry about it - the details on you they have got can probably (almost certainly) be obtained easily enough by a company such as MH even if you never owed them anything (it's relatively easy to track a name to an address*, even an old address using readily available sources).
Date of birth isn't much harder to obtain at a guess..

If they ring again tell them you only want to be contacted by post and that you will not even communicate with them until they supply the full and true (I believe is the term) signed copies of the credit agreement they will of course have for your "debt" (after all they wouldn't ever dream of breaking the law/guidelines on collecting debts, would they....;)).
Remember it is up to them to prove any debt, not for you to prove you don't owe it, so if they can't provide the legal proof they can go jump off a cliff and you don't have to talk to them.:)

There are some standard letters you can send asking for the details (copy of signed agreement etc), and for them to only communicate with you via the post, i'm afraid i don't have the links/letters handy but i'm sure someone will post details soon (otherwise i'm sure they've already been posted in this thread somewhere), one very sensible suggestion I've heard about sending the letters is to use a signature that is very different to your own, or a computer printed one (monotype corsiva for example), just as a general precaution when dealing with DCA's (some of whom probably wouldn't worry about copying a signature onto a blank CCA if they didn't have the original handy).

When they cannot provide the proof remember to send a complaint into the relevant watchdogs, including the fact the debt seems to have magically appeared when you rang to let them know the person they were looking for wasn't at your address.

Good luck with the baby, I hope everything goes well :)

*From memory the phone book and electoral registers are both common sources, and if you've got copies of them going back a few years you've got a chance of getting the right previous address by comparing the Mrs A Smith's who have moved in the time frame.

  • I have had a good old argument over the phone with a female from MH. SHE CALLED MY MUM

She requested my mum to pay up. They have received the letter of statued barred.

She said its not statued barred as a payment was made in 2002 of £100.

I have asked my dad whom was paying this he said he had not paid it in the last 7 years.

I said to her "I would like original evidence of this payment, from the original creditors"

SHE SAID: "I don't have to provide you with this evidence as your mum has received this in 2004"

I said "I have the right to see this evidence of the last payment of this so called "2002 payment" from the original creditors"

She said: "I do NOT have to provide you with that information"

I then argued against with "Why?"

I said, "I'm going to take this future with professional legal advise"

Then I said "I have also researched on bad reports about MH"

She said: "I don't care what you have read, go read it again and seek your legal advice" THEN SHE PUT DOWN THE PHONE!

    I thought, GET LOST

They can keep trying all they like.

Does anyone have any emphasis on this?

Sounds like MH are entering into the 'panto' mood of 'oh yes it is/oh no it isn't'.

The fact is, though, Caliber - Mackenzie Hall must give you an up to date statement of any 'alleged debt' on request.

They really are the 'lowest of the Low'.
