    Got a letter from MH, or rather, I assume it is, as it was sent to my parents and all i've been able to do so far is google it's return address....

    When it gets to me (my mother is posting it down), and I write asking for a signed copy of the credit agreement, I don't acknowledge any debts etc... Should I be writing from my current address, or the address they have for me?

    MacKenzie Hall use a software program ( http://www.afd.co.uk/news/pcnews/pn44.asp ) to 'trace' old debtors by their last known address or postcode, in the expectation that their letters will be forwarded. Your mother has no obligation to pass it on to you and could, legally, have returned it marked 'no longer at this address'.
    However, I would find out what the 'alleged debt' refers to. If it is, as I suspect, a very old debt, then there is really no need to go down the cca route. Providing that you have made no payments to, or acknowledged the 'alleged debt' in writing, for a period of six years then the 'alleged debt' will almost certainly be statute barred.
    I would send them the letter that you can find on the following link:

    This will place the onus on MH to prove whether or not the 'alleged debt' is statute barred, and therefore no longer enforceable through the courts.

    hope somebody can help me. have recieved a letter from RED DEBT COLLECTION stating i owe abbey national £909.68. I havent had an acount with these for over ten years!!!! Can someone please tell me which letter i send them requesting for more details? is it the one asking for an agreement? I have also recieved a letter from SRJ recoveries stating i owe carhone warehouse some money. As i was unaware of owing anything to these i requested credit agreements from SRJ. they refused stating i had to ask Carphone warehouse. Help please what do i do now
  • :T Hi Guys ! Newbie Here.jjust had a blazing row with some !!!!!! on the phone at MCKENZIE HALL!!!!!!.
    I was sent an sms to call them to discuss a debt i had with them?!? !!!!!! ,I thought!
    I finally got through to them a 2nd time,after they would not speak to me without a reference number,and I had this guy telling me i had an outstanding debt with them reference barclayloan.I pointed out to him that I have indeed never had a barclayloan,or indeed dealt with barclays at all in my life.This inept fool wouldnt listen,and continued to spout facts,dates and figures to me about my so called debt i owed!! I tried to explain to him that I have had a similar convo with another company approx 18months ago.We had just moved into this address -LL postcode and there must have been a chap with a similar name to myself -previously at an LL postcode who was in debt up to his eyeballs.I spoke to the lady,explained the situ,and she happily removed my details off there register-which is how it should work isnt it.
    But no,
    this guy would not have it,he got irate when i refused to give him any information over the phone,and he said he would look into my case and get back to me.I reassured he that "he wouldnt be looking into anything" as I have no case with them or anyone in connection with them.He still refused to listen,which sadly resulted in me losing my temper and telling him to send any further correspondence via post for me to pass on to my brief.

    Have i done all I can do now.? they are a very intimidating company who use bully boy tactics to muscle there way through.

    It is against the OFT guidelines on Debt Collection, for a Debt Collection Agency to threaten action which they cannot take, or to pursue a person who is not liable for the debt

    Quote the relevant sectios to them and there CEO may be less inclined to come back. Then write to them, copying it to Trading Standards the OFT and the FSA.

    Also, have a look at the website of the Credit Services Association (professional body for DCAs). http://www.csa-uk.com/csa/ You will find our friends Mackenzie Hall in the members list. On the home page, under 'What we do' there is the Code pf Practice for CSA members. If you think MH have breached this code in any way you should report them to the CSA who will strike them off if enough evidence is received.

    I see I am not alone when it comes to dealing with Mackenzie Hall (MH) and Acquired Debt Limited (ADL). It also appears that I experience the same as others when trying to call the number MH supplies in their letter. How can you prove it is a legitimate company.

    I received my first letter from MH 16th April 2007 saying that I had to pay off the debt of £117. I read the opening statement of the letter and it stated that we wrote to you last week advising you of Litigation Proceedings would taken against you. My first response was 'what letter?'

    Reading further, they asked that I filled out a Standing Order Mandate to pay £6.51 per month until the date is paid off. Instead of doing this, I sent an email to [EMAIL="acquired@mackenziehall.co.uk"]acquired@mackenziehall.co.uk[/EMAIL] and [EMAIL="complaints@mackenziehall.co.uk"]complaints@mackenziehall.co.uk[/EMAIL]

    I didn't know anything of the six year rule or this site at the time, but I quoted 'under the law, I have every right to be given proof that I acquired this date'. To date I have received no reply to this email.

    My second letter I received from MH, stated that the company I owe the debt to has halved the debt. (What company??) I ignored this letter, because in my first letter, I stated that if I did not received confirmation of this debt within 21 days I will deem this matter closed. It has now been 5 months without receiving any proof of the debt I am supposedly owe to ADL or this company that halved the debt.

    Today, I received a TNT posted card with perforated edges (like a payslip) with the following address on the back: PO Box 7381 Glasgow G51 9BG. When I opened the card up, MH had sent a statement:

    We have written to you but have not received a response from you (UM Hello, what about the email I sent you which you have failed to respond to). Please call 01563 554544 quoting ref no M1****** immediately to avoid action being taken against you. Should we fail to receive a response to our communications, we shall have no other alternative but to pass this account to our field collectors who will call within the next 7 days.

    So I decided to a some research and I came across this site. I have copied the letter, adapted it and it will be posted recorded delivery tomorrow. It surely pays to do your research. It is a shame when I didn't do this in April!!

    As someone stated in another reply "MH/ADL bring it on".

    This is another post the vile parasitic vermin, Mackenzie Hall…

    About 8 months ago they wrote to our address, but using the name of my wife’s late mother (she died in October 2005), as the addressee.

    They were demanding payment of a late payment charge from Studio Cards (my wife’s mother was a customer of theirs), not for a debt as such, just a charge for late payment. We phoned and wrote to Mackenzie Hall, telling them the person they were after was deceased and that we were not going to pay them anything.

    Then this morning we received a letter from an odious bunch of turds called Meritforce Doorstep Collection Agents (again with my wife’s late mother as the addressee).The letter says they work on behalf of Mackenzie Hall. They are threatening to send a collection agent to the door and to take legal action, unless they are paid immediately.

    What should we do next?

    I am an 18 stone former rugby player, with a wide variety of sharp power tools and would be happy to post the doorstep collection agent back to meritforce in several parcels (provided they agreed to pay the postage). However, I don’t really want to take this option as we have just had a new carpet fitted and don’t want it getting dirty.

    Does anyone have any suggestions please?

  • I received one of these payslip type letters today but said in it:

    "Please call 01563 556546 no later than 17th September 2007. If the above person is not you please call 01563 556549. This is not a circular or junk mail. We need to speak to you urgently. Regarding Reference Number M*******. Thank you."

    My question - I've no idea what this is about but can they send baliffs to my door? I've read what peoples experiences have been on the site and really do not want to call them when I don't owe anyone money or claim that I do. Shall I just ignore it?

    Hi Mark - Meritforce have absolutely NO LEGAL POWERS WHATSOEVER.

    They should NOT visit your home without a prior appointment, arranged with the debtor - I would suggest that that is a bit difficult as your mil is no longer with us.

    To be honest, I would be tempted to let them attempt to 'take legal action' - the judge will 'laugh them out of court'.

    I do accept that this type of 'harassment' and bullying threats can be a bit difficult to accept, and I would suggest that you take some advice from CAB or Scottish Debtline on how to 'stop' this harassment.

    Mind you - I, personally, could see the merits of your suggestion. :rotfl: :rotfl:
