    You should send the letter that tomterm8 has copied above in post #27, only remove the "Without prejudice" as it should not be used in this type of communication under any circumstances.

    I had specific personal & legal reasons for sending this letter "without prejudice", that would not apply to 99% of people.

    You are right that anyone who copies this letter should remove the "WITHOUT PREJUDICE" tag unless they have a good reason not to do so. Sorry... it wasn't my intention to provide it as a template letter, but just to describe my own response to McHill.

    I just received the "Please contact David Smith at Mackenzie Hall immediately..." text! I feel privileged.

    Strange thing is though, is that it came through on my work mobile which was issued to me just two weeks ago. This is part of a package of 3 or 4 phones, so I believe this is a random spam-scam (I just made that phrase up - good eh?). I have no debt either.

    Besides, if that was that important they'd phone me. Don't fall for it!

    There is also a tag at the bottom of the text... "2 remove rply 1vwd". Spam.

    Actually i'm an oversea student,i came to the uk when i was 17 in 2001,i was studying in the uni in year 2004.and because of my financial problem,i couldn't afford the tuition fees(i paid for the first term),then i did withdraw from my course after discussing with my course leader,and i filled in the form and gave it back to the uni.
    but after a few months,the uni ask a debt collecting company to get the rest of the tuition fees from me.u know,if i didn't say anything and leave at the beginning,then it would be my problem,i solved everything and came back to London,and finally got this problem which i shouldn't have.
    i called the debt collecting company and told them that i shouldn't pay anything.but they said if i failed of paying this money,they would inform the Homeoffice.then i gave them 500 pounds,after that my friends suggest me just ignore them,because it's nothing to do with Homeoffice.so until now i haven't paid any more after that.
    I don't know what to do.is it gonna be a big problem to me?
    anyone,please help!very much appreciate!

    Ive visited 3 or 4 forums today with literally hundreds of posts regarding this company. I too have recived several letters claiming that i owe them x amount of money (bizzarely this amount always seems to change) anyway i urge you all to contact BBC's Watchdog programe.. if enough of us tell them about it im sure they would investigate them... anyway here are is the link...

    Out of interest, I would like to know more about this 'after 6 years a debt is cleared/can't be colllected etc...'

    There must be a limit to this no?
    Let say I create a debt here in UK and move abroad - bcse I'm not form UK originally I would absolutely have not link with UK anymore
    so let's say I owe money but leave the country, travel around, knowing than after 6years anyway they can't do anything about this ... and it seems that you don't even need to leave UK for this to happen anyway.

    ... I don't know but this seems just to easy for me
    So is it only for amount below £500 for ex ???

    Is the point 'well if a company did not care for years to chase someone to pay then that's there problem' ...do I get it right?

    mh, must remembers to have fun and buy lot of things if I ever leave this contry :D

    Earlier this year, my boyfriend was being harrassed by Mackenzie Hall for a debt from a bank account he had never even held! They sent three or four letters demanding immediate payment of around £1000 and threatening court action if he failed to pay. When he spoke to them on the phone to query the debt, they were incredibly rude to the point of being obnoxious.

    Luckily (for us!) I knew about the statute barred rule from reading these forums – gotta love MSE – and as the debt they were chasing was outside the 6 years that they have to chase it up in, I sent them the same letter that people have posted on this thread and guess what? We never heard from them again!!!

    Don't be bullied by Mackenzie Hall! You have every right to request further information on the alleged debts – this does NOT mean you have acknowledged the debt – and on receiving this info (which despite demanding immediate payment from us, took weeks to come!) study the dates carefully. If the last action was over 6 years ago, send them the template letter and if you're lucky, you'll never hear from them again!

  • A few weeks ago I had a letter which was followed by a text message asking me to contact Mackenzie Hall immediately, after reading this forum I decided not to take any action. Until this morning that is, when I received a demand for £796.86. I’m honestly don’t recall owing anyone, ok I owe lots, perhaps I should have said never “defaulted on a payment”
    The only possible answers I can come up with are I may have signed as guarantor for my Son at some stage but if that’s the case it would be over 13 years ago as he passed away in 1994, the other alternative is I may have acted as guarantor for my daughter in law, even that must have been a few years ago as we’ve not been on speaking terms for a while.
    As I said I don’t recall acting as guarantor, but if in did, surely whoever the dept was to they’d come to me first before going to a dept collecting agency.
    In the mean time I’ll send on Monday a copy of the draft letter posted by “File Wizzard” unless anyone has and updated advice

  • My elderly parents have recently been sent letters and getting phone calls from Mackenzie Hall relating to a debt from well over 10 years ago.

    Could someone please advise as to what they should do? Would the letter as mentioned in previous postings be sufficient to put them off?? I've checked with Citizen's Advice who mention that as long as they don't acknowledge the debt with MH - then it should fall under the "presecription and Limitation (Scotland) Act 1973"


    Anyone any thoughts on this?

    Please follow the advice given by File_Wizard, in post 3 of this thread, and send a copy of the template letter.

    Mackenzie Hall specialise in attempting to collect alleged debts which, normally, are covered by the 'Statute of Limitations Act' and are 'Statute Barred'.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

    I received an almost identical letter last week and while I'll admit I'm no stranger to being chased for debts (I went through a bad patch at Uni followed by a low paid job) something about the letter made me check online which led me straight to this forum. The letter doesn't refer to any debt - even though it's clearly chasing an outstanding debt - so I don't feel I can follow the very good advice on here regarding the letters that have been sent requesting further information. Do any of you have any advice on how to deal with this? After reading previous posts, I don't feel like calling them!Thanks
