I sent a CCA request to 1st Cretins and heard nothing. Sent them the 12+2 days letter and have recieved the following from them today.
Dear Sir / Madam,
Thank you for your recent correspondence.
Your letter has been passed to the appropriate department and they shall respond in due course.
Yours faithfully,
ADMINISTRATION DEPARTMENT
Anyone else had this?
About 7 times, whenthey reply next time saying that they are asking the OC for the CCA ( again ) they will get,

I have had 2 accounts passed to first credit by the BOS had the abusive and threatening phone calls so I wrote to them offering a settlement figure and said I would not discuss this over the phone please put everything in writing,had phone call refusing my offer so I wrote again increasing the offer stressing the fact I would not talk on the phone please write,I did not answer the phone when they rang or reply to the request on my answerphone to call them back still no letter from them all quite so I wrote requesting the CCAs they soon replied to that.Do I increase my offer to them ? how do I get them to write ?0

I can't believe my last post was at beginning of October. That's how long it's been since 1st Cretins contacted me. This time they said that "as they know not of any legal reasons why I have not settled this account they will be commencing court proceedings". As this obviously proves how thick they are, I've decided not to waste any more paper on them (and the price of recorded delivery) and let them have their day in court.
Just prior to Xmas I did receive a letter from them which was on the creditors headed paper and was a retrospective statement from my creditor having sold the debt to them - it wasn't signed. Be interesting to see their face if, when taken to court, they find I've scanned their letterhead and typed a letter apologising for their harrassment and writing the debt off. It wouldn't be difficult. Of course I would admit it was a hoax, but it would prove to the courts how easy the process is.
As an aside, I also have a DCA chasing me for a debt that the creditor has confirmed in writing as being satisfied. Where do DCA's get their information from that they can chase for something which no longer exists? Is there a monthly listing which gets posted somewhere, the same as in probate cases?
Anyone who is worried about dealing with any unscrupulous DCA's should definitely listen to the advice on here. Look how many posts are on this thread alone - you are not alone, doesn't that tell you something?!?!0 -
when making an offer for full and final settlement what percentage of the debt would be a fair offer?0

just checked OHs credit file on experian, citi account shows as defaulted, with balance claimed, no mention of it being "sold" and no mention of 1st credit as one of her creditors. what gives?

We attach an edited copy of the signed agreement in respect of the above account and would ask for your comments.
a) If you confirm that this is your signature we will of course send you a complete copy of the relevant document. We would also invite your proposals for settling this outstanding debt.
b) If this is not your signature we would ask you provide our office with a copy of your signature from an official document, (such as driving license/passport), to substantiate your claim. Please be assured that the matter will be investigated immediately.
c) Where an address is detailed that your do not reside in we would ask you to comment on whether you ever resided at the address and, if so, the period of your occupation.
d) If we believe that a fraud has taken place against you we will advise you. In these circumstances we would reommend that the matter is reported to the local Police and 1st Credit Ltd will of course co-operate fully to ensure the matter is thoroughly investigated.

What loverly cheeky chappies they are. I ask for CCA and they ask for my comments!!!
Lets take each case in point.
a) I'm sure I should not have to confirm my signature in order to obtain ALL the documents.
b) I'll send them a copy of my signature - yeah right.
c) Errr I think the onus is on them to prove I was at that address?
d) How nice of them to assist in fraud - I must have seen them in a bad light and they are really nice people at the end of the day. Hold on a pig just flew past my window.
What response do you think is best. Obvioulsy there is a template for not a CCA and also one for having to provide a signature. Do I write the "non CCA" letter? The "wanting signature" letter or do I combine both?
Or indeed do I need to write back at all? They have failed to come up with a CCA so its still in default until they can prove otherwise?

give 'em a false signature, if that "signature" later turns up on your CCA you have 'em bang to rights.
they replied to me with something about going to their client, strange i thought they said they had a deed of asignemnt and had bought the debt. they'll make up their mind one day, either they are acting as agents for their clients or they are assignees and they where asigned the deed by the assignor. they cannot be both?0 -
You can use whatever Signature you want to.....if you use your real one put a line through it.
If they are so unsure that you are you then what are they doing sending confidential info to you in the first place.....OFT Giuidelines again.
We need to keep the Complaints up against this lot......£50K per case is at stake here!:D stay wonky

yes applied for cca had an email accounts put on hold until all paperwork sent to me0
