Problems With Neighbour & Private Drive-Advice Needed!

Just after some advice if possible.

We have a private drive with a drop kerb that we paid for about 5 years ago. We have enough room for 3 cars but we only have 1 car. I am disabled and have regular visits from nurses, doctors, carers, OT, cleaner etc, so the spaces are used almost daily.

Our neighbour opposite has started using our drive to park and turn around in as they have 5 cars/vans in their household. Is he allowed legally to do this?

OH is getting livid about it and wants to go and have a go but the neighbour is a nasty ba**ard and we have never had any problems with neighbours before, so dont want to rock the boat.

We spent alot of money a few years back to have the drive imprinted etc and the drop kerb cost alot too...do we have rights or are we being petty?

OH is thinking of buying 3 security posts that you cement in the ground and has to be unlocked with a key.

    um we used to live next door to a txat who thought he owned the whole parking lot :rolleyes: dont know your rights but if you can i would say yay get the posts save you a load of grief to come!:D

    Thanks for that, but still confused to what my rights are. Nearly everyone in the cul-de-sac have drives, its just they have so many cars and vans and your not allowed to park on the roads here.

    If it's your drive - and not council owned - then that is your land and no, he had no bloody right to park there.

    If you don't want to speak to him then bollards would be an idea although it means you could be in and out the house letting various people in.

    I would ask him to politely not park as this is your drive. If he persists then key his van and let his tyres down during the night!!!:rotfl: :rotfl: :rotfl:

    No, if he persists then you may have to get the bollards. I would have a quiet word first of all.

    It is HA...does that make a difference then? Surely, if we are renting the property along with the land/drive then the same principles apply:confused:

    I think we will just go for the bollards. I can give a key to my nurse/carer for one of them and the other OH can nip out and open....its a nuisance but worth it in the long run I think.

    I also use a wheelchair and if they park close, I may not be able to get into the car. I dont go out much but do have regular hospital visits.

    I just think they are out of order. I would never dream of doing aything like that to anyone else.

    Why don't you speak to the HA? My previous house was a HA tenancy and I found they were much more helpful than the council (ususally as their profits benefits the tenants and not 'fat cats'.)
    You could explain the issues you are having and see if they can write a polite and firm letter to the offender pointing out your need for access.

    I would also check whether you can erect bollards. Technically you are only renting the land and I know that my HA were very picky about what you could and could not do to your property. It may damage the drive and this would need to be replaced if you ever decided to move.

    I will check that out in the morning but they didnt have any problems with us laying a new driveway etc, so should be ok.

    Bollards definitely are the answer to keep unwanted drivers out. I live in a cul-de-sac, once I parked my car elsewhere because I ended up having an unplanned drink in the evening. The next morning I was awoken by my house "moving". Yes some bright spark had seen the space afforded by my double driveway and decided to use it to turn in. In doing so they "accidentally pressed the accelerator instead of the brake" to quote the fool behind the wheel and crashed through the front of my home.

    The hassle in liaising with the insurers and arranging repairs was unbelievable but at least I was at home at the time to grab the driver before they ran off. I always park across my driveway now so no-one is tempted to do a 3-point turn.
