    Unfortunally they don't seem to send the items themselves as they are based in Plymouth and it seems to have been sub contracted to a company in my local area derby.

    I haven't spoke to them on the phone since sending that email as I'm working 7.30 - 5 and by the time I get in they are shut although I finish at 3.30 on Fri so I can try speaking to the MD then.

    Its not the toilet seat that's the problem sorry if I didn't explain it well it its the actual pan which is where you do you well you know you thing. :rolleyes:

    As I said before i don't see what the big deal is with them as I'm prepared to spend more money to get the right screens and yes if necessary pay to get the other ones returned.

    I shall have to look into sale of good act as I have not heard of that before.

    Speak to the company and see what they have to say. If they refuse to help you could go to the Small Claim Court.
    From what you say you will certainly win on the toilet pan.
    It would then be between you and the company to argue your case on the screens. It's worth a shot.

    How did you pay for the goods? If you used a credit card your card company are equally liable and may be helpful in helping to sort the problem out.

    Hi Again

    I did indeed pay by credit card as I always do with Internet orders in case of problems arising like this one.

    Do you think its worth ringing my credit card company first for advice before getting back in touch with home-supply?

    I just want to be fully ready with all the information and ammo I need before I contact them so I know what I'm on about.

    Is this a good link to read about the sale of goods act?

    Yes, speak to your credit card company and tell them the problem and inform them you hold them equally liable. Ask them what they will do to assist you in sorting it out.

    There are many good sites for Sale of Goods Act but don't worry about getting too technical. You simply have to quote, in the case of the pan, that the goods are not of merchantable quality and you want a refund/replacement under the Sale of Goods Act. It will be this act you rely on if you go to the Small Claims Court. Leave it to the Judge to know the detail of the act.

    Not having much luck with lloyds tsb at the moment as I keep getting passed from department to department.

    I got another number to ring after my dinner so fingers crossed they can help.

    Well I got through and they wernt much help.

    They have basically advised me to talk to trading standards as its been a couple of months and I have actually received the items.

    I shall have to try them when I get in from work tomorrow.

    Your bank is just trying to stonewall you on this one. Have a read of the article below then put a letter together to your bank.

    It won't harm to talk to Trading Standards but their service seems to vary from one area to another. You may be lucky.

    Cheers for that.

    I have spoke to consumer direct on Friday and apart from yourself they have been far more helpful then anyone else I have spoke to.

    They have told me to write a letter to the company and point out the sales of good act for the toilet pan and that they are in breach of contract for the shower screens.

    And then to finish it of saying you have 14 days to respond for further legal action will be taken.

    That I shall be getting onto later and I will be sending it recorded delivery tomorrow.

    I would still write to your credit card company as well. If you get them on side they could get a speedy conclusion for you. Point out that under the Consumer Credit Act 1974, section 75, they are equally liable and you expect them to honour their responsibility. If you quote the Act they will know you have done your homework and know what you are talking about.

    In the end you may have to revert to legal action. The Small Claims Court is the place to go. Depending on the value of the goods it will cost you around £30 but you will get this back together with your expenses when you win.

    Good idea thanks.

    For the sake of writing another letter and a couple of quid to send it recorded it could pay dividends in the end by helping speed the who situation up.

    £30 is nothing as far as I'm concerned to get this sorted as they 10x that new as if it did go to a small claims court id ask for it back.
