Hello
Can someone tell me my position over the following please. I'll probably give too much info but that is the whole picture.
8 weeks ago I ordered 2 sofas and a lamp. The lamps were £199 each or 2 for £300 but as we were buying 2 sofas (£2000) I managed to get them to sell me 1 lamp for £150.00 I paid for this at the time on my credit card but got the sofas on free credit over 5 years rather than the 3 years they were advertising. Yesterday I chased them over delivery as they had told me 6-8 weeks and I had not heard from them. I then received a phone call saying that they could no longer supply the lamp new but that I could have one off the shop floor. I asked for a bit of discount because the lamp would not be new and they said NO because I had had discount already. Frankly I don't want one that's been on display for ages so can I cancel the order and get my money back (it's taken them 2 months to tell me) or as I do like the lamp can I insist on a discount (it would have be a big one though). Also is there anything I can do about the late delivery of the sofas? They said 6-8 weeks it's going to be more like 10-11, when I bought them I told them I needed them by 1st July and they said that shouldn't be a problem but as of yesterday the material hadn't even been cut yet.
Thanks for any help you can give me.0 -
Sorry got another one...which might help someone else.
Less than 3 months ago we bought an Epson printer from PC World. We don't use it much but the 2nd time we did it had stopped working. So we took it back. They told us that Epson would charge us £10 to send it off for repair. I was speechless - as it's still under guarantee, can they do that ? Is it legal? We were expecting a new replacement or a free repair.
Thank you again0 -

If they will not play ball, ask for their head office address.
Write to their chief executive, John Clare, copy the store where you bought your printer. Outline your problem to John Clare and tell him what you want them to do for you, replacement/repair/refund. Remind him of his responsibilities under the Sale of Goods Act. Tell him that if the matter isn't resolved within 10 days you will take them to the Small Claims Court. Send the letter recorded delivery. That should do the trick.
The parent company of PC World is now DSG Group where John Clare is the chief exec.
I haven't forgotten your other query. (sofas and lamps). This will take a little longer to deal with but I will get back to you later today.

Hi,
I bought an mp3 player from Argos today and extended cover, its not covered by their normal 16 day return policy but its not working, if I get another and that doesn't work, can I have my money back for the player & extra cover or will I have to keep getting replacements? Its playing up so bad I'm not really sure a replacement is a good enough option.
Thanks0 -

I wonder why MP3 players are not covered by their 16 day retuern policy.
Basically, you can demand your money back. Take it back tomorrow without delay so they can have no excuse for giving you a refund.

Firstly, the lamp. Why can't they now supply a new one? Is it because they have given you too much discount on it or is it now discontinued? If they can't get you a new lamp you are entitled to a full refund.
You can't force them to give you any extra discount for the floor model if they refuse to do so. You must decide if you want to buy it at the price they eventually offer. It's worth having a look at it to see what condition it's in.
With the sofas you should have written 'Time is of the essence' into your order with them and stated the maximum time that you were prepared to wait. It's worth telling them they have failed to fulfil their contract and ask for compensation. If you decide to wait for the new delivery date they are giving you, write to them and tell them that the new date will form part of your revised contract with them and you will sue for compensation if they let you down again.
Is the retailer a national company? If so, it's worth writing to the MD. Put your story to him, tell him you are very dissatisfied and ask for compensation for the problems you have had.
Should you decide to cancel your lamp or sofa orders you are entitled to a full refund on both.

Write to John Clare MD of DSG group. Send your letter recorded delivery. Tell him how disappointed you are at the lack of response and ask him to deal with your complaint. In the letter state that you feel you are entitled to the difference in price and look forward to receiving a cheque from him.
