    Hi,

    From another disability forum where a member inquired with the DVLA about the use of the Disabled Tax Disc by a family member to travel to/from work. The reply from DVLA cut and pasted from the thread was:

    Thank you for your email.
    To qualify for the exemption the vehicle must be used by, or for the purposes of the disabled person - for instance to get a prescription or shopping for the disabled person.
    If the vehicle is ever used in a way which is not directly for the purposes of the disabled person the exemption will be lost and the normal rate of vehicle tax must be paid. Use by such as a family member for their own purposes such as their work use would not be appropriate.

    That seems pretty clear to me that it should not be used in the cases mentioned above.

    It does seem bizarre that I could use my son's DLA for any purpose I wish with no questions asked but from what you are saying not use it for a motability car because I use it twice a week to go to work. Perhaps I should hand the car back, give up work, claim carers allowance and spend the dla on myself!

    I strongly feel this use of the car massively benefits my son both financially and because it gives me a balanced life allowing me to look after him so much better.

    Some people on this forum seem to perceive that everyone is out to cheat the system and to be honest have made me feel quite awkward.

    It is not the question of the disability car that is in argument. It is not paying the car-tax, if the vehicle is used for any purpose other than for the disabled person. The government link already posted is very clear.

    Just use the vehicle for the purposes of the disabled person and there is no problem, but use it for other purposes and the car-tax should be paid. In fairness, everyone has to pay their own expenses to get backwards and forwards to work, and just having to pay for car-tax seems a cheap option.

    I am sure that your comment about giving up work and just claiming from the government was made in jest, but every worker feels like this at times.

    Sorry, I didn't post above to make anyone feel awkward. Quite the reverse in fact. It just seems very bizzare to me that on the Motability Website it does seem to say use by a family member is permitted. However Motabilty Lease cars are now automatically taxed as disabled (with no option to tax one as Private for example). The DVLA seem to have a very restricted view of what a disabled taxed car can and cannot be used for.

    Perhaps the ideal to clarify things would be for Motabilty and the DVLA to come together and issue specific guidelines as to permitted use for the vehicle. This would clarify things and perhaps stop the sniping and awkwardness that the current apparantly vague situation lends itself to.

  • Surely its up to the person to decide what is best for them? To receive high rate mobility DLA in the first place you have to meet the criteria. If, you then decide to use that money to (rent/hire) motability car (& I am talking total allowance here) that is up to YOU - how is it anyone else's business? I think some are confusing the blue badge scheme with the motability scheme. Also please don't forget that DLA a non means-tested benefit and you are at total liberty to work full time & receive DLA.

    Im with you on this one , I would carry on as you are, ive checked with a friend of mine who has already contacted dvla about this.We are allowed to use the car without the disabled person , shopping prescriptions etc are some of the reasons , using the car for work inbetween is still classed as benefiting the disabled child and family.I wouldnt let any of this worry you.It isnt me , i have never had any trouble with using our car , we cant have a mobilty car without road tax etc being classed as disabled. I really dont think dlva would waste time and money pursuing this.
    I have rang dvla over 30 times since october last year. There is some lads that live up the road from us who have been driving around in an untaxed car for almost a year.They say they will investigate and dont, phoned police and they cant do anything. So i really dont think they are going to chasing after a parent of a disabled child

    You do not have to have a Motobility car to have a disabled tax disc, if you claim HRM componant but have your own car you can still claim the tax disc.

    That isnt what is being said , what we are saying is you cant have a mobility car without a disabled tax disc.

    I know, I meant that even without a mobility car you can have the tax disc and the car is not limited to only 2 drivers, therefore the car itself is not classed as being solely for the benefit of the recipient of the HRM allowance.
