    hi all i phoned homebase today to be told that there was a possible misprice and that it was being looked into by specialist team told them they best hurry as they were quick enough to take my money !

    About the T&C. i have a website and my T&C state that a contract is not formed until the goods are dispatched. You can pay a year in advance but the contract is not formed so all you can do, if the company does not give your money back when you ask, if to take them to court for it.

    I used to accept paypal but because people order goods from me that are 'to order only' then I think it unfair to charge people until i have them in hand. So now I process all payments manually when the goods are ready to be sent. Most of these huge companies have payment processing that goes through when the order is placed - I can have this set up on mine, s the payment goes through a 'gateway' but then as I said, I prefer to take the money when the goods are ready to send. If I advertise something at the wrong price and have taken the money and then realise, if I have sent the goods then the conteact is formed, if I catch them before the goods are sent then I refund the money and no contract exists.

    The T&C will cover Homebase with this. They could have just said 'sorry, it is out of stock' and everyone would have accepted that even though the money had been taken and then refunded - but Homebase have been honest and said it was a pricing error. Just because they have 'the same shed' it does not mean it has come from the same suppier and has the same model number - this can make all the difference too.

    I am gutted too, but we need a shed so it is back to paying the price I was going to pay.

    Homebase and Argos often have pricing differences, a catflap I wanted was £6 in Argos and in Homebase it was £12!! And they are next door to each other.

    Wickes do one or £125 and B&Q for £129 if that helps.

    What makes you and Homebase think their terms and conditions overide British Consumer law?
    The point at which a contract is formed is well established in British Law. Case law surrounding this very point was made many many moons ago. I could look up the actual case that set the precedent but cannot be bothered.
    This is when an offer to treat is made and a price agreed between both parties then a contract exists. This was of course in the old days of cash and face to face transactions.

    There is a grey area in certain circumstances.
    That has never been tested before any court. When someone buys something on the new fangled interweb thingy they pay with a card. the card is much like a cheque in that it promises to pay for whatever.
    The person putting the card number in may take the view the contract is formed as soon as he has done so. The seller will take a different view and usually will insist the correct point is when the goods are despatched.
    Clearly under these circumstances there are two differing points of view. It is the role of the courts to expedite these views and decide upon which is the correct one.

    Any individual or Company that takes payment for an item that was given in good faith for it following on from advertising it at what could be seen as a reasonable price is in error.

    The key tests here are and the ones a court would consider.
    1. Was it reasonable to expect a discount on the scale advertised (ie was it silly money) The Clapham Omnibus test.
    2. How did the advertising medium promote the item.
    3. Was the item paid for in good faith?
    4.Did the vendor take all reasonable steps to ensure no one was inconvenianced over the situation? Ie could they have stopped the online payments (some went through a full three days after the so called error was noticed).

    The main point I am trying to get across is just because something is mentioned in a set of Terms and Conditions that supposedly you have to agree to before you make a purchase doesn't make it bombproof. Indeed far from it. It's becuase of !!!! ups like this and challenges before the courts that these t+c documents get ever longer and more complicated.

    So I take it that you are just making a point......
    Its not like any of us are buying a house, just a shed and not a very good shed at that as I have seen the quality of their sheds at Homebase in Hamilton.

    As mentioned in many posts, it is considerate of Homebase to offer those of us who ordered sheds at the wrong price a £10 voucher for our inconvenience. I say well done Homebase, as far as I can remember I don't recall any other retailer offering any compensation for a misprice in past mispriced goods.

    Maybe they have allocated all vouchers, i was told 20% off shed or £10 gift voucher, or you might have misheard ?
