hi i ordered a shed for my sister on sunday and she hasnt had a phone call or nothing yet, also i just checked my credit card statement and the money has been taken out but its showing up as argos direct, are homebase and argos connected in some way as i havent spent any money in argos so thought that its bit weird showing argos.0

I'm in the same boat. Order Saturday night (?) and had a confirmation email right away. Money only went out of my account today.Bet match total as of 04/10 = God Knows + About £1000 Quidco. Time for Mrs Huddsta to have a crack!!!

I know these type of threads go through a cycle of "hope we get it" then it goes "Im going to sue" etc.
Ive gone in for most of the misprices that come on here and never got one, never taken it any further as I understood that only when money is taken then the company has entered into a contract with you. I had been told this on numerous occasions and there was the Dell external hard drive a while back and Computer Active magazine took up a couple of peoples cases and the company had to supply the item at the misprice as Dell had taken their money.
But every time I never had money taken, but for this I have had the money taken this morning.
So I decided to call Consumer Direct just to see what they say.
Managed to get mr angry! . Bloke was really off with me ( probably had 100 calls about sheds today!) I just asked to confirm the sale of goods act with him. He said if a retailer advertises a 50" plasma TV for £50 and you order it, they do not have to honour it EVEN if they take the money although a contract is formed. He said that there are "get outs" for the retailer like if the difference between the correct price and the misprice is quite big then they legally do not have to honour it if money is taken. He said there is no laid down guidelines as to how much the difference should be.
He also said, as posters on here have said they can put whatever "clauses" in their T&Cs which can contradict the Sale of Goods Act!
I phoned Homebase and the refund has been issued so thats that but it has opened my eyes up to the fact that the Sales of Goods Act in relation to contracts means nothing at all as there are so many grey areas.0 -
