  • hi, all just a question for any 1 who,s got any advice , wrote to tsb on the 2nd of feb asking for case to be looked at its been in the court system since august 2007 recieved a reply saying looking into it , send a expenditure form plus a pay slip, now last week i phoned andover and the lady said even tho u in f/h we will not be refunding any charges till after the test case , now i havent had no letter saying this and now we into april any suggestions on what i can do next cheers jill

    I am currently in a DMP with Payplan and have been for the past 2 1/2 years- would this allow me to reclaim bank charges on hardship grounds

    I wonder if someone could help shed some light on this for me. Last week after waiting 12 weeks for yorkshire bank to deal with my claim for financial hardship, they finally offered me only £25 of the £1000+ im claiming. They tell me that they only give back charges from within the period of financial hardship.

    I watched martyn lewis this morning and he seems to think that they give back money back from before this period so I just phoned the FINANIAL OMBUDSMAN to see if they can clarify this for me and they said that they are not sure about this and will look into my case for me.

    The problem is i said to yorkshire bank that if that is the rules then i just have to except their terms.

    They are all a bunch of GREEDY BANKERS!

    I THINK THEY WERE LYING TO ME AND I WOULD LIKE TO HERE IF ANYONE ELSE HAS HEARD ANYTHING LIKE THIS. THANKS

    A DMP will sometimes show you have your finances under control and unless you have mortgage/rent/council tax/utility arrears or court claims etc against you from anyone not accepting the DMP then it would be doubtful you would be receive any interim payment on hardship grounds.

    You can reclaim charges back from July 2001 as per the FSA waiver. The issue with hardship is any payment now is to relieve hardship, so no it shouldnt matter when the charges were incurred.

    Whats the status of hardship you are claiming? do you have priority arrears? (co tax/mortgage/rent/utilities)

    What is the status of your hardship? Lloyds are quite strict on terms of hardship and often won't pay out unless you are about to be made homeless through arrears. Write back to them detailing your circumstances.

    if you get that in writing send it to the FSA. Banks DON'T HAVE to refund you under hardship rules but they do have to consider your complaint.

    They are correct.

    It really depends on individual circumstances. If your DMP is controlling things and you are managing okay with your debts and have no priority arrears then yes its unlikely you would obtain a refund.

    I was made redundant back in november so since then i have been on job seekers allowance while my girlfriend was on maternity leave. we worked it out that we was well over -£100 per month with the bank.

    They seemed helpful at that time even suggesting other costs to add on. My girlfriend returned to work last month (but i did not inform them of that) but last week has now gone on sick leave for the forseeable future.

    Any way last week i excepted this £25 from them but i just felt that they was fobbing me off and i want to investigate this situation. I told them as far as i understood i was able to claim all charges as you state but they said i was wrong.

    Can you point me the way and show me where this is documented so i can read up about it and then i will phone the bank and complain

    You need to do this in writing. They don't have to offer you a single penny (unfortunately), but they can't just pick and chose what charges they will pay back. Have a read up on the waiver - espcecially the Annex on financial difficulty - http://www.fsa.gov.uk/pages/Doing/Regulated/Notify/Waiver/pdf/disp_monthly.pdf - should give you a better idea what to throw at them.
