    I have searched this forum extensively, I have a friend who had lodged a complaint with the FOS and is awaiting their response, has anybody got any information about the CO-OPERATIVE BANK? as i have not seen any posts about this bank.

    Any victories? Any info at all would be greately appreciated.

  • I started a claim under the financial hardship waiver on 1st January and kept receiving stalling letters, none of which addressed my point. I wrote again and again even including articles from the internet which I printed off. I then made a complaint to the FOS who have given Lloyds 8 weeks in which to respond. If I am not happy with the final response from Lloyds, then FOS will make a decision.

    I was made redundant last July which was a huge shock as I had thought it was a job for life. As a result, I am in considerable financial hardship. I was out of work for many months and only just started a new job as a hugely reduced salary. Lloyds made huge charges against my account so I quickly cancelled all direct debits, but they are now charging me huge daily charges on top of the amount charged in the first place. Its nothing but legalised theft. They phone me several times a day, but I refuse to answer my phone, as I have no wish to speak to them. I want everything in writing.

    If the FOS doesnt rule in my favour then my next step will be taking it to court. I think Lloyds must be the worst bank in the world!

    If the FOS do not agree with you then the court will place a stay on the claim. That will mean waiting for the outcome of the OFT test case issues.

  • Hi all,

    I put in five separate claims yonks ago via Money Claim Online, and three of those were settled before the thing went on hold. Now I'd like to try for the financial hardship thing for the remaining two, but am not sure what total I should be asking for, in terms of interest.

    On the original claim form it includes the charges amount, plus an amount for interest at 8% per annum from the date I was deprived of the money, which it says is accruing at the daily rate of 0.021% until judgement or payment.

    So I'm not sure whether I should be stating the total as the amount of the charges, the amount with the 8% interest, or do I need to calculate the current amount, based on the daily accrual and give that?

    Thanks for any advice.

    Just a quick question and its a silly one.
    I read about financial hardship and all the questions asked are correct. Things keep bouncing out of my account, Im 10k in debt with debt management and my bills are high. However, I was going to claim hardship but how much research do they do into it?

    For example, do I say to them how much I earn and then spend on items and they pay up? Or do they want bank statements, wage slips etc?

    I feel that I won't be able to claim because I'm not that hard up. Each month after my £400 rent, £300 debt management, £40 mobile, £100 virgin media, £20 sky and £70 bus fares, I still have about £200 left. Is that enough to claim for this? Or would they say, Thats enough to live off.
  • was hoping to get some help here have claimed under the hardship rules i1st month bank repayed £300 last month paid £550 this monthwont give any cash but will repay utillity bills to the tune of £2753.00 can they do that they want to pay all companys direct but will then knock it off what they owe me can i insist they pay me direct as i have other debts grateful of any help here

    You haven't included coucnil tax, food and clothing on there. Try a search for 'annex 2' for what is considered as financial hardship.

    You might do well to post an SOA, statement of affairs, on the DFW board so people can see where you can make cutbacks. There are a lot of helpful people on there.
  • I have a claim with Smile (Co-Op) . I have made a request under hardship rules . They agree I am in harship as they are dealing with my DMP through CCCS .
    However , they say that although they have an obligation to address the financial difficulty . this does not include an obligation to process refunds of charges until the outcome of the test case is known .

    Is it worth pursuing further , or is this a brick wall to basj my head against ?
