  • Hi I am newbie to the forum and the whole claiming PPI, bank and credit charges so am looking for some advice. The PPI forum girls have been great and I have started the ball rolling with them.

I had a complaint with the Halifax in October 2008 accepted their offer and still waiting for the refund to go back into my account. Spoke to them 3 wks ago and they confirmed in writing it would be credited to my account within 7-10 working days......still nothing.

I want to claim all the charges they have incurred on my account together with interest charges which they havent charged me since January but between October & December have and if they had credited my account with this refund back then I wouldnt be paying the charges, so I need to send another letter to them and find out why they still havent credited my account checked the telephone banking system and nothing still balance same as it was.....?:mad:

Also have also made a complaint to Abbey about bank charges and asked for these back -they wrote to me and said they wouldnt be refunding them as its the banks policy da dad blah blah etc etc so then I received a further letter saying my complaint is being dealt with?

What should I do - how do I go about claiming financial hardship to get these charges back? Any help would be greatly appreciated. thanks

  • Just had my reply from my bank after claiming financial difficulty. After them telling my that, yes i was having difficulties and completing their financial exercise, all they have offered is to suspend any further charges that will occur on my account. Even though i told them that i had stopped all dd's so that i dont get any more charges. Theen they tell me that i still have to wait for the outcome of test case. this is so frustrating. Will the FOS actually be able to help? Any advise?

If they have suspended charges then they have complied with the FSA Waiver on Bank charges. Banks do not have to refund or waive any charges prior to the conclusion of the OFT test case issues.

I got a reply from the Financial Ombudsman yesterday. I already complained to them once a while ago, and I quoted the reference number. I also explained I had requested £2500 in charges back from Halifax and that I was in financial difficulty.

The letter from the Ombudsman reeked of a template letter and mentioned nothing of financial difficulty. I don't even think they read my form. They said they would not be urging the bank to process my case!!!

    Now what??
  • Hello, this is my first post but i will try and keep it brief. I am falling further and further behind with my banks. I reclaimed from Lloyds £1000 but Barclays went to court and a stay was applied. The judge did say in court that although they could apply charges they cannot chase me for the money but i dont have this in writing so i am worried that i may not be able to uphold this if they come calling for it.

Now i am getting many charges everymonth so who do i speak to first with regards to making a claim under the hardship ruling?

Can someone help me please? Also, can i make a claim on my credit cards without paying the upfront court fee i had to pay for the bank claim?

Any help would be very much appreciated. Thanks
  • Hi

It's my 1st post on here. I've had a claim on for approx £4k with HSBC, I recently sent them a request to re-open my claim due to financial hardship as I have been made redundant.

They sent me an income and expenditure form to complete, which I did. Then they called me a few days letr to go through it with me. I think basically trying to catch me out to see if I made any of it up! They then called me back a few days later and said that although they agree that my income and expenditure leaves me with no money left over, because of the amount of money that has recently been credited to my account (my redundancy money) that I should have spent it more wisely and therfor they have turned down my claim!

Does anyone know if I can do anything else now?

    Thanks

How much redundancy did you receive and do you have mortgage/rent arrears/co tax arrears etc which they are saying you should have spent the money on? Or did you claim simply on the basis of being very tight each month?
