    Who should I write my letter to?

    A. The FSA's hold on banks dealing with the reclaim has been lifted, so the rule which allowed those in hardship to have their case heard while everyone else was on hold is now irrelevant.
    However, under FSA regulations, banks must treat you fairly anyway and be considerate if you are in hardship

    If you read the post above your own one it has a link to the lending code section 9 you need on financial difficulty. If you are a student and you are struggling then speak to your student union about hardship funds and speak to advisors there who can give you some good advice.
    If you are going down the financial hardship route then you will need an I&E form and their address which is on the legal beagles site

    You need to register to download their own I&E and make sure you get the natwest one since the rbs one is there as well.

  • Hi all, I have not heard anything from the FOS for 14 weeks now, i called about 4 weeks ago and they said they were still waiting to hear from Halifax. Any idea how long the banks have to respond to the FOS. Is there any point in it anyhow ? since the court case i have been expecting a letter saying something like sorry your case has been closed ? cheers Dan:confused:
  • i know its probally been awnsered a million times ive just seen the new claiming guide for bank charges.Im going to claim harship on the claims of losing my job being consistenly charged making me in the red.
    do i go straight to the ombudsman or do i contact the bank 1st??
    how long will it take for either of them to get back to me??

    I have had my claim with Barclays on hold in the county court since 2007. Yesterday, i was told that i am being made redundant at the end of Feb! Would I now qualify for Financial Hardship, and how would I get this moving with the court, or is it worth trying to resolve still through the court????

    hiya i too am soon in this position and was wondering the same, therefore have you read the upto date info on claiming the charges, i got the weekly email from this site today and if you registered you should see the email and have a read, i think we can but im unsure when to approach the bank i already am in dispute with halifax due to their new charging 1.00 a day but now unsure how to react to the new claiming proceedure

    so if anyone can help much appreciated cheers maz

    Two things, firstly, the court do not deal with Financial hardship claims and the only issue with the courts is remission of fees when filing a claim.
    The second thing is whether you have contacted the bank with regards to the financial hardship?

    On my signature is the lending code. You need to read carefully chapter 9 on financial hardship. Please contact your priority creditors and see what they can do. If there is no room for manoevre with them then contact the bank who should provide an income and expenditure form which should be completed and sent to the bank with the reason why you believe you are in financial hardship with reference to the lending code.
    If you do not use your account at all anymore then do not expect anything via financial hardship albeit some banks will pay out past charges even if the account is no longer being used.

    I am about to try my luck on reclaiming bank charges based on the financial hardship route.

    Quick question...Can i include that i am on maternity leave and will only be receiving SMP in a few months time? Can i also include that i have a possibility to go on remission of a previously diagnosed illnesses which have prevented me to do full time job and has caused me to go part-time and if it happens, (which i am praying not to) i might again go into part-time when i return to work? It surely worries me about the future of our spendings. thank you for all your kind advice. :A

    Anything which causes a reduction in income leading to arrears on priority creditors(mortgage/rent, council tax, utilities) can and should be included. The bank does not have to refund any charges under financial hardship but it does have to look at your situation sympathetically.
