Can I say that last week my bamk gave me £2069 as a "guesture of good will" it said on my statement

So chin up, and plead poverty, give them a sob story, throw in suicide, spoling relationships with your off spring. my letter should have started "once upon a time" it was so long.
    BUT IT WORKED!!!

I now have to use this to stay in the black

I was 1250 over drawn (have 1 over draft facility) cleared the OD with this ammoutn, and put the rest into my saving account.

I am now writing everything down that I spend each week, and have a budget (after all house hold outgoings - not including shopping) as £155 a week.
I hope that I can keep in control my my finances now, and learn my lesson :)

sorry but i echo natwest on this ,that undermines genuine cases
missed direct debit charges, very odd, theres no pain so how come the big gain,i.e £39.00 for a letter
  • Just recieved a letter from the FOS who have been looking at my financial hardship bank charges reclaim with the Co Op. The bank knocked me back 3 days before the test case saying that I had £1200+ disposable income. Thats my whole case. As my FOS rep was on annual leave her colleagues suggested I contact the bank directly, which I did they asked me to send in info on the debts that I couldnt pay and complete an income/expenditure sheet again and said they would review my case.

Today I had a letter from the FOS saying that they did not feel that the bank should honour my claim and stated that from my correspondance that they felt that I was expecting that the FOS tell the bank to honour the claim. They said that their view of my complaint remained unchanged (that I was not entitled to recoup my charges). The funny thing is that they never told me that that was their decision in the first place! The last correspondance was that they were waiting for a response from the bank!
I suppose there is no point in persuing this further!

Where does the £1200+ disposable income figure come from ? and is that per annum or per month ?

I dont really know. The ammount I think comes from the wage slip that i sent in my monthly salary was around that figure 2 months ago. I have over 2000 per month outgoings, my salary has now reduced to around £900 per month as the hours keep getting cut.

i phoned the FOS to give them a piece of my mind as I had no idea that they thought that the case was untenable. The advisor basically said sorry the letter was a standard template and she could have worded it better. The last time i corresponded with her she was waiting for info from the bank. She said that she felt that the bank had done all it could for me as in advising me to contact CAB or debt advice and that they still let me have my £200 overdraft which they could have taken away. She also said that as I dont go over my overdraft too much - some of the charges relate to when I had DDs coming out and the bank told me to cancel them - that I was managing the account ok. I cant go over even if I want to the bank just wont let me! (which is a good way to avoid charges). I said that this was a silly argument. The FOS basically said that thats it as far as I am concerned and that the test case had meant there little that she could do.
  • Hi all, just to let you know, I have spoken to a guy at Natwest today who has 100% guaranteed me that I will be receiving a refund of charges... offer letter ready to post to me, but awaiting legal team to double check the wording on the offer letters.
My hardship claim was accepted 21/11/09 - letter received told me that I would receive an offer within 21days... following test case I didn't think I stood a chance of getting an offer, so was over the moon with todays revelation (I really hope he was right!).
There may still be light at the end of the tunnel for those of us with genuine hardship claims guys - fingers crossed! x
  • I put in a hardship case to the Abbey in March 2009 (my original bank reclaim was in July 2007). I got nowhere with the Abbey as they just sent me standard letters saying they would come back to me etc etc. I took the case to the Ombudsman who said they thought I had a good case - this was in May 2009. The FSO didnt assign me a caseworker till July 2009 and since that time have been telling me they have been requesting information about my case from the Abbey and still havnt received it, although they also said they received the wrong information 3 times from the bank. I called the Abbey the day after the Supreme Court Ruling to find out the status of my case as the FSO said I wouldnt be affected as mine was a hardship case. The Abbey said all hardship cases are now on holding pending the negotiations they are having with the FSA. I called the Ombudsman back and they said that was not true so I asked them to confirm with the Abbey as I was really confused by this point! The FSO then called me back to say actually yes they had spoken to the bank and my case was 'on hold'. I asked how long this might be for and they said they didnt know and would keep me posted.
Its now been nearly 8 months since I registed my compliant with the FSO and I understood they would normally take 6-9 months to resolve a compliant?
I dont know if there is anything I can do now? I am still in hardship and on benefits and my claim was for £6,000.
Any help or advice would be appreciated.

I have applied for a refund of bank charges some time ago. Have just found out it is possible to use financial hardship as a reason to get my case heard. Is there a draft letter out there that I can used to send to my bank, and is it worth doing it? I have read some of the postings and it doesn't seem to making any difference.
keep trying, send letters first then keep ringing them and be firm, i got £760 back last week, so dont give up, keep on their backs

  • Can I ask that NO ONE USES THE MSE HARDSHIP LETTER AS IT IS TODAY. It refers to FSA Waiver which no longer exists. I have brought this up with site team so I hope it is being worked on. Thanks guys.
Letters sent prior to November 25th are ok
