Hi,
Halifax are a joke!!! Have just spoken to them and they have read the letter to me that has been posted today. They have basically acknowledged my financial position and have therefore offered to not add any further charges for 3 months while I correct my financial situation!!!
They owe me thousands, if I owed it to them it would be a different story!! I'm fuming!!
What do I do now???? Please help!!!!!
Do I ring the Ombudsman?0 -
Hi there everyone, I am new to the forum, but not new to the site !!
I wonder if i can ask some advise please? I am in possession of an A&L form as above. I am happy to complete this information and am genuinely not having enough money each month to pay bills ..... BUT i am scared if i complete this form and send it to them that "number 1" they will just treat me as a normal applicant and i am wasting my time trying or "number 2" that I will get some kind of black mark for declaring i am struggling to pay .....
Hope this makes sense. I am interested to know other peoples experiences with filing in this form and A& L's responses.
Thanks everyone and nice to meet you all !!
Thanks Emma:eek:0 -
They have to deal with Financial Hardship under the FSA Waiver on Bank Charges(the link is on my signature). The hardship element is on PAGE 11.
The banks' do not have to refund charges but they can suspend or delay charges pending the outcome of the OFT test case. I suspect that case of Financial Hardship will get pay out first prior to anyone else(albeit court cases will get paid in the order in which their stays come to their conclusion--I would imagine).0 -
Hi I Am New To This And Hope Someone Can Answer Some Questions For Me I Applied For Unfair Bank Charges With Hsbc Several Months. When I Requested For A Refund Of Charges I Also Stated That I Was Curently In Finacial Hardship, I Filled Out The Income And Expenditure Forms And Sent These Back After Alot Of Phone Calls And Getting No Help I Wrote Back To Hsbc. They Sent Me A Letter Back Saying They Had Looked At My Case And Did Not Agree That I Was In Financial Hardship I Provided For Them Detials Of The Debt Management Company I Am Currently Dealing With Letters From Loan Companies With Whom I Have Failed Payments Etc Etc. I Was Told That Even Though I Had All This It Did Not Show I Was In Financila Hardship I Think This Is Totally Anfair And I Am Very Upset At The Way I Have Been Dealt With. I Am Not Sure What I Need To Do Next, I Have Read Some Of The Other Posts And People In Same Situation Have Written To Ombudsman, Who Are They How Do I Contact Them? Its such a travisty that institutions can treat human beings like this,
I am about to goto war with Lloyds TSB and felt I needed some information to "ready for combat" I came here and I see the horror and hardship everyone here has suffered at the behest of the greedy few.
My heart goes out to you all, after two and a half hours of reading this thread I am shaken to believe that this bullying can be allowed on such a scale.
I wish you ALL the very best of luck that your claims are expidated.0 -
Hi, just thought I would give my good news Halifax have made me an offer on my bank charges on the 9th December the offer is only £200 less than what I have paid in charges so I am going to accept, due to financial difficulties I can't afford to argue the point. Anyway I am still reeling from being made an offer.0

I have had an offer under the financial hardship scheme today from Halifax. They offer £1349.00 but as a condition they insist the money is firstly paid to my Halifax overdraft limit, which will use the full amount of the offer.
I have called the number on the letter to discuss the condition. I explained that as I was in financial hardship, struggling to meet my monthly utilities and mortgage payment I would want the money refunding to me either to another bank account or by cheque. Then my intention would be to use the money to pay arrears on utilities and mortgage and to continue paying my Halifax overdraft at the agreed amount of just £27.50 per month.
I fully understand why they want their money back first but the whole idea of this claim for me was to help me out of the sticky stuff for a month or two whilst hunting like crazy for a second job.
What I want to know is can they tell me how my bank charge refund is to be used? And if they can't what do I do?
I have a form which needs to be returned in the next 5 days to say whether I accept the offer with the attached conditions.
Look forward to everybody advice!0 -

I am claiming under financial hardship from the Halifax.
I received a letter today saying they acknowledge it and I should contact national debtline and that my case will be put on hold awaiting the outcome with OFT.
What do I do next as I thought they had to deal with it as I am claiming under financial hardhsip??0 -
I think Halifax are awful to claim back against.I put my claim in last year then a few months back wrote asking my case to be looked at under financial hardship.I have had to fill in the forms twice and now they have wrote saying that my monthly income is more than what i put down but its not.I have sent a letter back saying they should know what my income is as it goes in my bank everyweek so i will wait and see.0
