Natwest charges total £304 they paid £76 back last year. I've claimed £228 but they offered me £152 I referred it to the FOS who sided with NW and said I'm only owed £152. The FOS have missed several points I made in my complaint form which I find really annoying. I've sent him an email and asked him to re-read my complaint form.explaining that he'd missed important points. Has anyone else had any problems with the FOS and a lack of their attention.

I just had a call from my adjudicator at the FOS (hardship claim has been ongoing since March this year). Adjudicator reckons he can't process any claim for bank charges due to OFT waiver?? I am right to pursue with him? I thought it was an exception to the FSA waiver that allowed hadship bank charges claims to continue through the FOS. Do I have a leg to stand on? Or have I got it all wrong?

I have received an offer letter today from Natwest- for the full amount I was claiming, under financial hardship- which I am very pleased about.
However I have 1 concern.
After speaking to them on the phone today, I asked how they will refund the money. And as my account is still open, I was told the money will be refunded back into my account.
Currently, my account is £90 over my overdraft limit.
If the money is paid back into there, I am worried they will remove my overdraft and hence I will not be able to get the money? I was told by the woman on the phone they won't do this. Is this true?
Another slight concern, is I have a student account, with a free student overdraft. But I am no longer a student as of this summer, but have not informed my bank yet. Could they have already removed my overdraft because I have had it for 3years?
Can I request they pay it by cheque or anything?
What is the best thing to do? I am just worried I won't be able to get the money.0 -
I have written to HSBC twice now. On both occasions I stated that I was not interested in any other products they have to offer. Their replies both stated that they would consider my claim BUT ONLY as part of them re-scheduling debt or alternative borrowing. I moved my account to A&L so have no outstanding debt with them.
Typical, they are trying to sell me another loan to line their pockets rather than deal with the issue in isolation.0 -
Hiya.
I am having problems with HSBC, I spoke to their Financial guidance team in July and they advised me that they didn't consider me to be in financial difficulty or hardship so therefore I would have to wait until the end of the test case.
I then recieved a letter from HSBC a week later advising that they recognised and accepted that I was in financial hardship, but that I had chosen not to compy with any of their suggestions.
I wrote back advising that there had been no suggestions made at all, and that one person had told me I was NOT in financial difficulty, but their letter stated that they accepted I was, and asking them to contact me to acknowledge this!
I had no response to this letter and wrote again, enclosing my complaint to the FOS, and advised that they had failed to respond to my earlier letter.
On Friday (last week) I spoke with HSBC regarding a managed loan to clear my overdraft (a large proportion of which was made up of bank charges £1300/£2000), and the guy on the phone said that there was a 'service failure' registered against my account, which was related to my complaint, and I would be recieving a letter in the next few days which would outline their investigation into this.
I then recieved a call from HSBC yesterday regarding my bank charges to tell me that they had reviewed it and would not be paying anything back until the end of the test case.
Where do I now go with this- HSBC are obviouly aware that they have acted unfairly by acknowledging a service failure, but can I send this onto the FOS or should I wait until they contact me?

Hi the adjudicator from FOS has written today basically saying that because we are not indebted to the bank there is nothing they can do."it wolud not be right for us to uphold your complaint about bank charges solely because you are having trouble paying debts owed to other parties".I guess its back to square 1 & wait for the outcome of the test case!!Thanks to everyone on here,especially Natweststaffmember!!!0
