Just another success story with bank charges, I first wrote to my bank in May, and yesterday they credited my account with the amount I had claimed, plus interest.
I really didnt think I would get a penny back, but I used the advice from MSE, and am extremely pleased with the result. I would urge anyone who has had these charges unfairly added to their account to give it a go.:T

Hi,I have applied to the FOS with regard to a hardship claim.(I have 6 months arrears on mortgage!).Have just had a letter from them saying that my claim has now been passed to their Hardship Team & that they are waiting from a response from my bank.Does this mean that I will hear from the FOS a bit quicker as it is now with hardship team?or does this not make any difference?I would appreciate if anyone has any rough idea of a timescale!Thanks:rolleyes::p0

I have just received an offer from Natwest for £4808.. was claiming for £5119. It has taken months and they wanted copies of mortgage statements, loan details but it has all eventually worked so keep on trying!!!0

Hi, I'm looking for a bit of advice really regarding bank charges and reclaiming them. Background info: In the last 2 years I have received £450 in bank charges, and the past 12 months I have really been struggling financially so I made the plunge and wrote to the Halifax last week using the template letter asking for a full refund. I got a letter at the weekend saying that they do not deem me in financial hardship therefore they won't refund any of the charges until their is a judgement on the court case. I phoned them today asking what consistitutes financial hardship and they said arrears on your mortage, not meeting bills and having people dependent on you. Well, I don't have a mortage and nobody dependent on me but I am struggling to pay my bills, I'm only 22. Last year I had to stop working to become a fulltime carer and for 6 months I was not entitled to a single benefit whilst a carer so I just lived on my overdraft, my bank account hasn't been in credit in over a year. I asked the snotty women at Halifax today what else I'm suppose to do and I was told that it isn't their fault I am in debt nor did they care they keep taking bank charges because they are lawful. They said they would only refer me to the money management team, helpful...not! I spoke to the FOS and they took some details regarding the bank charges and the fact I'm suffering severe financial hardship, they've said they'll only reclaim the charges for the past 12 months when I was unemployed and experiencing hardship. They have said I need to either wait 8 weeks before they can carry on with my complaint or I have to receive in writing from the Halifax a letter saying its their final decision on the matter. I was just wondering if anybody in a similar situation could advise me on what they mean or how to word such a letter to the Halifax. They have terrible customer services and I'm just fed up with them £35 or £28 a time (sometimes both amounts) in bank charges, I can't earn anymore money nor can I plant a money tree

I am in the same situation as you, Halifax agreed my hardship but refused to pay out, I did a MCOL but that got stayed but luckily I got my letter thru from the FOS Friday saying it was now being referred to a caseworker and they had asked the bank to fill out some forms as to my claim.
I called them today and she said the bank has 21 days (from the end of July when the form was sent) to return the forms a responce to the caseworker, the case worker then has 28 days to contact me to ask me for more info if needed. If not then the caseworker will get an answer out to me on my claim within this timeframe.
So...can anyone tell me....what wil happen now the bank has written to the FOS...will they now argue it out, or pay me out, or reject the claim?

i wrote to abbey june 23rd and as of yet no reply with regards to my hardship letter. seems like theyve just ignored my letters so i now need a letter of some sort to send to abbey......???
allso theyve got debt mgt recovery services to get on my case to pay them back overdraft which incidentally abbey took out of my JSA a few months back. so not only did they do that, ignored my letters but have now got the check to use a debt collector to get money...whats the best letter/s i can send to both abbey and the DC?
