    As yourbank would say. never send the letter to the branch but to their head office

  • The text is quite difficult to read but I would agree with the bank, however do you have any credit card charges?

    I have never incurred any credit card charges, only ever had 1 credit card that I paid off and closed the account. Can I ask why you agree with Halifax? I may not be a home owner in arrears or children that are dependent but am I struggling financially and that money would be extremely helpful to my situation. I don't see why Halifax should have 2 groups of criteria that they based their financial hardship cases on, every individual case should be assessed and based on the individual.

    I am in the same situation as you, Halifax agreed my hardship but refused to pay out, I did a MCOL but that got stayed but luckily I got my letter thru from the FOS Friday saying it was now being referred to a caseworker and they had asked the bank to fill out some forms as to my claim.

    I called them today and she said the bank has 21 days (from the end of July when the form was sent) to return the forms a responce to the caseworker, the case worker then has 28 days to contact me to ask me for more info if needed. If not then the caseworker will get an answer out to me on my claim within this timeframe.

    So...can anyone tell me....what wil happen now the bank has written to the FOS...will they now argue it out, or pay me out, or reject the claim?

    Does anyone know?

    Although this may be the correct address to write to initially, all reclaims are handled by Abbey's Bradford office. Address contained in appropriate thread.

    My claim has been with the Financial Ombudman for nearly a year now, and they have agreed with the bank (LLoyds TSB )that I am not in financial hardship. I never got a debt management form from the bank, the bank never even contacted me apart from the standard claims on hold letters. My claim is for just over £4000, nearly lost the house due to reposseison, still getting letters from the bank saying further action will be taken if I keep going overdrawn and still getting charges. Brother in law successfully claimed and he is financially bettter off than me. Surely something is wrong with this system

    Banks are looking at severe financial hardship which is priority debt arrears ie rent/mortgage. council tax. utilities.
    I would sit down and work out how much you normally spend excl bank charges and how much you earn and try and cut down as much as you can and see whether when you do an income and expenditure form whether it is a plus or minus

    Ask the bank if they can send you the paperwork that LloydsTSB sent to them and when they sent it. If you are still incurring charges you can still ask them to relook at your case. You need to do an income and expenditure form, plus notices of priority debt arrears. Can I ask how you managed to avoid repossession?

    I avoided reposession by borrowing from my dad. I have asked the bank for an expenditure form but they reply with the standard claims are on hold letters. I even forwarded a letter to the FSA from LLoydstsb that threatened me with further action If I continued to go overdrawn, there was also a letter from LLoydstsb that said we normally charge £20.00 for refused direct debits. I have had three charges over the last threee years that were all over £200 each for a refused direct debit, the highest being £300. LLoydstsb have yet to reply to my letters asking for an explanation of these charges. What gets me is the way the bank has managed to fob off the FSA, because I am repaying a loan with LLoydtsb and have never defaulted on the payments they see no reason that I should be in financial hardship. The FSA say that the bank is not reponsible for other debtors or payments, I understand this, but the point is that when they start taking £300 in charges you are unable to make other payments, it is these charges that have put me in the situation I am in.

    Hi all,

    Apologies if there is already an answer to my question on the forums but my eyes are hurting from trying to find out!!

    In a nutshell, I started my claim for unfair bank charges amounting to around £2400 with HSBC in February 2008 after the case was put on hold and recently wrote to them citing Financial Hardship - I have no priority debt arrears ( mortgage, utilities etc are all up to date) however after a bad few months I am constantly going over my overdraft limit of £400 and being charged up to £100 per month.

    I had a response to my letter with an income and expenditure form to complete and a number to call to go through the info. I have spoken to a very nice lady today in the financial guidance team and she has gone through the budget planner with me. To cut a long story short I don't qualify under the hardship criteria ( which to be honest I wasn't holding my breath on anyway) but she has waived the £50 in charges due to be taken next month and has offered a managed loan to consolidate my overdraft with a personal loan that is already in place.

    Do you think I should agree to go down this route?
