I have never incurred any credit card charges, only ever had 1 credit card that I paid off and closed the account. Can I ask why you agree with Halifax? My claim has been with the Financial Ombudman for nearly a year now, and they have agreed with the bank (LLoyds TSB )that I am not in financial hardship. I never got a debt management form from the bank, the bank never even contacted me apart from the standard claims on hold letters. My claim is for just over £4000, nearly lost the house due to reposseison, still getting letters from the bank saying further action will be taken if I keep going overdrawn and still getting charges. Brother in law successfully claimed and he is financially bettter off than me. Surely something is wrong with this system0

I would sit down and work out how much you normally spend excl bank charges and how much you earn and try and cut down as much as you can and see whether when you do an income and expenditure form whether it is a plus or minus0 -

I avoided reposession by borrowing from my dad. I have asked the bank for an expenditure form but they reply with the standard claims are on hold letters. I even forwarded a letter to the FSA from LLoydstsb that threatened me with further action If I continued to go overdrawn, there was also a letter from LLoydstsb that said we normally charge £20.00 for refused direct debits. I have had three charges over the last threee years that were all over £200 each for a refused direct debit, the highest being £300. LLoydstsb have yet to reply to my letters asking for an explanation of these charges. What gets me is the way the bank has managed to fob off the FSA, because I am repaying a loan with LLoydtsb and have never defaulted on the payments they see no reason that I should be in financial hardship. The FSA say that the bank is not reponsible for other debtors or payments, I understand this, but the point is that when they start taking £300 in charges you are unable to make other payments, it is these charges that have put me in the situation I am in.0

Apologies if there is already an answer to my question on the forums but my eyes are hurting from trying to find out!!
In a nutshell, I started my claim for unfair bank charges amounting to around £2400 with HSBC in February 2008 after the case was put on hold and recently wrote to them citing Financial Hardship - I have no priority debt arrears ( mortgage, utilities etc are all up to date) however after a bad few months I am constantly going over my overdraft limit of £400 and being charged up to £100 per month.
I had a response to my letter with an income and expenditure form to complete and a number to call to go through the info. I have spoken to a very nice lady today in the financial guidance team and she has gone through the budget planner with me. To cut a long story short I don't qualify under the hardship criteria ( which to be honest I wasn't holding my breath on anyway) but she has waived the £50 in charges due to be taken next month and has offered a managed loan to consolidate my overdraft with a personal loan that is already in place.
Do you think I should agree to go down this route?0
