Did lloydstsb send a final response or did they not respond within 8 weeks?
but was my claim was on hold, however my position was getting worse than ever due to my financial situation with rent arrears and nort being able to meet my basic commitments. so i tried again with lloyds and sent them my details about hardship, then they said "all claims on hold"
sent my claim to the ombudsman and theyve accepted my case meets financial hardship and are pushing lloyds to resolve.0 -

Helped son fill out forms for reclaiming bank charges, reply recieved - please confirm household contributions - we did - they requested he phone them
He was bounced around 8 times between Edinburgh and Glasgow the call cost a fortuneand ended up in Human Resources being told that if he was applying for employment it could be done online:rolleyes:
He went back to Full time education after leaving the armed forces so was requesting hardship status0 -
Hello all....
Well it seems my hassling of Halifax has got me absolutely no where these last 3 momths.
I got 2 letters in the post today from the same caseworker. Both included a list of charges which was well over the 40 days timeframe they have but they only go back to 2003. So I just called them back and ended up in a very heated discussion with them about being able to request the fees back to 2001 and eventually she called me back and said they do not have a responsability to send them to me going as far back as 2001 but she will do it on this occassion.
One of the letters says:
"Until the banks legal proceedings with the OFT are concluded we will not issue or respond to any further communications received from you on this matter. Your complaint has been registered and will be resolved as soon as the bank legal proceedings with the OFT are concluded"
And the other says
"We acknowledge you are in financial difficulties but we are satisfied the fees were correctly applied to you account, However, in view of your circumstances we are prepared to cancel an fees on your account for the next 3 months.....
If you are unhappy with the decision please refer your claim to the Ombudsman....."
So I am assuming both of these are now final letters.....where do I go now?
Should I put in a claim to the courts?0 -

Using the excellent advice on MSE, we have registered his claim with the bank. In addition we have supplied a detailed budget sheet, a letter of support from the CCCS confirming that in their opinion he meets the FSA hardship waiver and copies of the correspondence from the mortgage company threatening repossession.
The Ombudsman has ‘acknowledged’ his complaint but suggests that the bank has 8 weeks to respond before they can even contemplate getting involved (his complaint with them was originally registered in 2007 but it’s only this year that he’s got into hardship). However, it is very likely that in eight weeks the situation will be a whole lot worse.
He spoke to those lovely people at the bank today (after about 3 hours of being shoved from department to department) and he was told by someone in Andover that “all hardship cases are now on hold” and that “the FSA and the FOS know and approve of LTSB’s position”!
So, please, does anyone have any suggestions please what on earth to do now?
I emailed the FOS and this is their response"Our position remains the same regarding hardship cases, as per the link from our website below which you may find useful:Kind Regards"0 -

The courts will stay the claim.
The FSA Waiver on bank charges:
"15.
When dealing with complainants in financial difficulty, the firm should consider the following steps in respect of the period during which they are assessed as being in financial difficulty:
(a)
the firm might waive future unauthorised overdraft charges; and
(b)
the firm might not enforce debts against complainants in financial difficulty to the extent that these debts are made up of unauthorised overdraft charges."
They have complied with the FSA Waiver albeit I would love anything in writing from banks post March 2009 stating they don't go back further than 6 years.0 -

I know they have complied but what is the point on holding charges on an account that is already closed? That is about as much use as a chocolate teapot? One of the account has been closed since 2008 and the other hasnt been used since 2008 so their offer to hold any future charges is a complete waste of time?0 -
