    CCJs are removed from your credit report 6 years after the judgement date. Settled or not.

    So this one will be gone some time before your actual bankruptcy itself comes off.

    That is why I say it's probably not worth the bother. The BR is worse on your report and will remain longer than the CCJ will.

    I only discovered this forum yesterday.

    I did not know about cleaning up my credit file as i assumed this would all be done automatically at the time of my BR (3 yrs ago).

    I have just joined experian and checked my file. All show as settled except

    1. A car hire purchase that shows as up to date but a balance of £1. Is this a problem?

    2. An american express credit card that shows as defaulted 3 months after my BR with a balance of £1200. This is highlighted in red and looks like it could be a problem? I do not know my account number with them. How shall i go about getting this rectified?

    I wonder if someone will be able to help me.

    My wife and I declared bankruptcy in March 2010 and were subsequently discharged in March 2011. We are in the process of tidying up our credit files at the moment and have prepared letters to go to all of our creditors regarding the update of Account Default Date and Settled (Partially Settled) Status on our credit files. This bit is pretty straight forward and we have no problems with this.

    When we start to consider our property however things get a bit more complicated...

    We held our main mortgage with Standard Life Bank and also (later) took out a secured loan with Nemo Personal Finance. During an extended period of unemployment we basically stopped paying both. Although they did everything they could to help Standard Life finally took the step to repossess the property. However this was some time after the bankruptcy order was made.

    What date should we ask for Standard Life to put as their Default Date? Should this be the date of the bankruptcy or (as I suspect) the date of the repossession hearing? Also the property was not sold for several months after repossession so is this the date at which the account should be marked settled (i.e. sale date)? Or should it be the date of the repossession hearing again?

    I would also be grateful if someone could tell me what date I should ask Nemo to put as the default date and date settled. They took no steps to repossess, in fact blocked a couple of sale offers. I think the default date should be the date of the bankruptcy order as this was effectively when their debt was encompassed in with the rest - there was never going to be anything left from the main mortgage to pay them with.

    Any guidance with dates for both Nemo and Standard Life would be gratefully received.

  • within a week i have sorted out my only unsatified default to hyundai/black horse not only did they have my default date 6 months after my bankruptcy but was still defaulting the account everymonth.

    first letter had the date corrected
    second letter satified the account with my discharge certifcate

    6 months till they now all fall off my file

    Hopefully someone can offer some advice. I have been trying to clean up my file most people have been ok, but a couple have been a pain.

    One company have changed the file to satisfied, but on my date of discharge not my date of bankruptcy is it worth writing to them again or should I just make a complaint to ICO.

    What is the "defaulted" on date? That should be your BR date, and it's that which is important.

    The date satisfied should be your discharge date, but is not really vital as long as it is satisfied.

    Hi all

    HSBC are claiming that it may take up to 8 weeks for changes to show on the files. Is this correct in your experience?

  • Hello i have been cleaning up my credit file for the last year now.
    after being discharged from bankrupcy and have this problem.

    I have a ccj still showing i currently owe £24k which was included in my bankrupcy.

    Is there any way of getting this ammended? i have spoken to barclays who insist it is not down to them to update! and to deal with the court directly. The court insist they cannot change the status without direct contact from the bank.

    oh the barclays account along with all others have been updated to settled/partialy setled on my credit file.

    I have 13months still remaining on the ccj.
    can you guys point me in the right direction?
