Bankruptcy Credit Reference File Clean Up - Discussion

  • Hello...

    my husband went bankrupt in december 2007 and discharged in june 2008. he had a loan with yes loans, we tried everything we could to pay it, we got the to lower the payments and they did but we were still struggling due to lose of jobs. my oh recently check his credit report online with credit expert and the yes loans says oh had 2 loans with them one included in the bankruptcy and the other didnt, even though they were the same loan..on his report it says he has 11 missed payments and a load of other things on his report just from that loan. what shall i do to correct this?? we have been getting letter from debt collectors about this loans lately thats what made us have a look at his report.

    any advice would be great.

    When I start my credit file clean up do I still need to quote the extract from the Information Commissioners Guidance in the letter if the letter relates to a DRO ending and not a bankruptcy ending?

    If not is there any substitute guidance I should add to the letter that relates to a DRO instead of bankruptcy? thanks.
  • Should I send another copy of the first letter I sent to the creditors to give them another chance? Or should my next move be making a complaint?
    (that's way over two months now since I sent the initial clean up letters)

    on checking my credit report today would like some advice.

    one of my defaults with egg shows a special start date instruction?

    i went bankrupt 5/12/2006

    its showing as defaulted 18/01/2006

    its showing a special instruction start date of 1/11/2009!?

    when will it come off? from the defaulted date or the special one?

    can they do the special start date or is this underhand by them?

    any help would be helpful thanks

    The only date that matters is the default one. It comes off 6 years from that date. The SI marker doesn't make any difference.

    Give them 28 days and if they haven't corrected then, then complain to the ICO etc..

    Copy via email to any complain/customer services/compliance email address you can find.

    May also be worth raising a dispute via the CRA, as that gives them a 'kick' from another direction.
