Strictly you should send them a reminder first. The ICO says that you should.
Just in case they use that as a reason to not uphold your complaint.

Hiya All, Just quick bit of advice please, was discharged 2 days ago, how long should I wait before getting my credit reports as dont want to apply for them too early as obviously will take time for systems to update so in theory reports could actually be out of date before I receive them? Thank you0

Hi,
i was wondering if I could get some help, did not know we needed to clear up our credit files after discharge! so have now requested our reports and on my partners it has not got his date of discharge on the file - do I contact the credit companys i.e experian to get them to up date this?
Also we have just applied for a rent to buy scheme and because we had not cleared up our credit files it came back with defaults (they said we can be br but with no defaults) but my partners credit check came back showing 2 defualts one I need to amend the other shows Settled but underneath PARTIAL, now this has flagged up on the credit report that the company did (as the girl who did the credit check advised us of them both and said one said partial on it) can i get this amended as I thought it would not show as a default if it has been settled??
many thanks in advance.

I was declared BR in Aug 2006 and discharged in May 07. I'm successfully cleaning up my credit reference file utilising the templates from this site but have 2 complications that I would welcome advice on:
1. My wife and I had a joint account with HSBC (my wife did & does not work - looks after our 2 children aged 3 & 5). HSBC have updated the account with the credit reference companies in line with the templates :-) and whilst we wrote to them separately (letter from me and a letter from my wife) I have received written confirmation of the change but my wife has not - even though they have correctly changed the details. Subsequently (within a week of the change), Metropolitan (part of HSBC) have now been in touch with my wife (phone & letter) demanding the money and not accepting that the debt is confirmed partially settled etc. HBSC are still within the 28 days. Whats the best course of action?
2. My CCJ (pre BR) with HFC account was part of my BR and as such should now be partially settled. Experian said I needed to get the court to address, the court said I need the OR, the OR said I need to get HFC to change details with the court who will then update the CCJ with the credit ref agencies. Note: because of the CCJ, HFC are not down as a default account other than the CCJ. I have written to HFC with a modified template letter. Is there anything else I need to do.
I would appreciate any constructive advice0 -
I have a question.
Now I am BR and separated, can I write to the credit agencys for a note of disassociation?? We had joint accounts he is solely responsible for now but we have no joint accounts since BR at all.
I hope I can, his credit rating is worse than mine!0 -
you can nothing stopping you...they'll also write to him asking why you are asking for dissassociation (sp)We all die. The goal isn't to live forever, the goal is to create something that will0
