Just got a new question:
I was under the impression if I got a new car I'd have to transfer my insurance to it, and they may charge me because of what's happening.
Now the solicitor I'm using is being paid for by the insurance company. I only have 3rd party so they're not paying for my car to be fixed. If I get a new one and transer, surely (as long as the car is in the same cat etc) I shouldn't be charged a lot as I don't have an "open claim"
Though I'm using the solicitor provided as the policy, this doesn't class as a "claim" right? As they're not paying for my car at all!
Thanks guys[FONT=Arial, Helvetica, sans-serif]"The internet is a great way to get on the net."

I think you need to tread carefully here. I don't know the way that the insurers will play it as you do actually have an open case, ie, the other driver could eventually bring a counter claim into play.
It would be safer to resolve the present situation if possible before adding any other complications.
I don't think it would apply in your case as you're 3rd party but many people are caught unawares when there car is written off. eg If, the day after you take out insurance your car is written off andyour insurer foots the bill, you then have a fully paid out policy and the next day you have to pay the premium again on the next car.
Sorry can't be of more help.I like the thanks button, but ,please, an I agree button.
Will the grammar and spelling police respect I do make grammatical errors, and have carp spelling, no need to remind me.;)

Hmm so I may not in fact be currently insured to drive this car if its fixed?
I've given up and told the garage to fix it and I'll pay the full amount. Will try and offer them in cash to get some discount or something.
As the insurance company would no nothing with my car due to the 3rd party thing I thought I'd be ok.[FONT=Arial, Helvetica, sans-serif]"The internet is a great way to get on the net."

No, I don't think thats the case. I'm sure that if your car is safe then you are perfectly legal to still drive it. I was just trying to make you aware that yours is a tricky case from an insurance point of view and your insurance could be increased if it goes against you. (which hopefully it won't).;)I like the thanks button, but ,please, an I agree button.

Well by the end of this week I'll have a working car, a utilised student overdraft, but mainly a court case in the making[FONT=Arial, Helvetica, sans-serif]"The internet is a great way to get on the net."

well someone pulled out on me the police attended luckily, she admitted liability then 2 weeks later changed her mind it then took a further 6 months to prove that it wasnt my fault.
I've been left quite deaf in 1 ear and tinnitus in both ears i have to wear hearing aids but finding it hard with nhs onesso im still waiting to be paid out as i know that insurance companies dont like to pay out quite a big sum of money before they know its a genuine case hopefully it will be sorted in the next few months because i've had enough of it all.
I hope that they find the guy and take his license off him the loon!
