    Ona you may find that doing this as a diary will be helpful to you as you go through the process. It will help to get your thought down and make things less stressful.

  • Blimey, thank you for suggesting getting in touch with the courts straightaway. I've just come off the phone and the next available date was 12th September!! So... 11am on 12/9/08 is now BR day - eek! At least we've got plenty of time to fill in those monster forms, although they look straightforward enough, and to get the fees together.

    I'm terrified, relieved and excited all in one - is that normal?

    Absolutly very normal. Someone compared BR to a roller coaster ride and they weren't wrong.

    Any problems with the forms just ask there is usually someone who can help.

    In Bath they are booking for the last week of September at the moment :eek::eek:

    Yes all normal emotions. Took me 2 days to pick the phone up and make a court date,then took me another wk before i printed the forms off. I felt, not relieved as such more positive,that i was actually doing something rather than hoping it would all go away.If you get stuck on any questions on the forms just shout. One of will be able to help.D

    12th September probably feels like a long way away but the timing sounds pretty good to me and I bet the weeks will fly by. You can get the paperwork together at a good pace and it gives you enough time to ask all the questions that'll come up. There's also time to really think things through about staying put versus moving. Don't worry too much. It feels insurmountable when you're just starting out on this process but it does get better.

  • And now for an update...

    We had our 2nd appt with CCCS over the phone just now and, yup, they had agreed that going BR is our best course of action and will send us a letter to that effect that we can include with all our court papers. EEK!!

    We have decided to move on with our lives by tying this all in with the relocation to Scotland that we've been wanting to do for 2 years but the house situation prevented us from doing so. We've been scouring the rental market and can get much better for our money up there too and will hopefully give us the fresh start we need. It's now up to my husband to find work quickly, which fingers crossed will happen as he has good qualifications and experience, so that we can move Oct/Nov time. If not, we'll have to put it off until the new baby is here so more likely early Summer assuming the secured creditors haven't kicked us out by then.

    I did a new thread the other week regarding our I&E and have now revised our figures, taking the advice on board, so that we can realistically achieve them and the OR can chip away a bit and not leave us high and dry. The figures are for what we'll actually be paying out at time of bankruptcy and will change slightly once we vacate our home:

    My income - £0
    Husband's income (net) - £1,680
    CTC - £40
    CB - £75
    SUB-TOTAL = £1,795

    Rent/saving for rent & fees - £700 (instead of mortgage/SL payments of £1,230)
    Council tax - £100 (spread over 12 months not 10 as per installment plan)
    Gas/elec - £93 (seems high but prices about to go up again!)
    Water - £35
    Telephone - £55 (includes line rental, landline calls, 2x mobiles & broadband)
    TV - £29 (includes Sky most basic package and TV license)
    Housekeeping - £450 (includes food, nappies(!), cleaning, toiletries & dog food)
    Pet - £20 (insurance & routine vet bills for immunisations, flea & worming)
    Dentist - £20
    Opticians - £10 (I'm a glasses wearer)
    Hair care - £10 (I only get my hair cut once a year at mo and do hubby's myself!)
    Holiday - £20 (accept this could be wiped, at least it gives OR something to take)
    Vehicle - £75 (includes tax, maintenance & insurance)
    Fuel - £40 (we try to use the car no more than a couple of times a week for shopping trips and visiting family mainly)
    Commuting - £187 (husband commutes to Manchester from Liverpool on the train - will fall dramatically once we relocate)
    Clothes - £40 (should I put more here?? I can't remember the last time I got new clothes)
    Home insurance - £31 (buildings & contents until we vacate and move into rented)
    Mortgage life insurance - £17 (will also stop when we leave house)
    SUB-TOTAL = £1,933

    It's more than our income but family have been buying some of baby clothes & nappies to help us out plus I am going without everything at the mo as well as getting free dental tretament and prescriptions whilst pregnant.

    We will hopefully be able to put up a good case to keep the car (currently worth £3,500) with us having 2 kids under 2 plus dog to transport even before I mention my home business which requires me to take stocks of books to home events and functions. If we were to rely on public transport I'd have to go shopping daily as couldn't manage much else with 2 babies in tow, which would be costly. If I were to use taxis, I'd have to be sure the car seats fitted every taxi and drag them round the supermarket with me. We also have a roofbox as we can't get everything in the car when we have to take the dog anywhere which is specific to fit our current car.

    I have to have the internet to run my home business, which I will get up and running again properly next year once the new baby is here and slightly less demanding, but this comes free with our Sky TV package anyway.

    I also have a little car that has been off the road for over 2 years that we aim to get fixed up (fit new wing mirrors that I already own, buy a new battery and put through an MOT) using the money from my premium bonds that I'm cashing in next week. Once roadworthy, it's worth about £1,500 and we then hope to sell it pre-BR and use the money towards BR fees and moving expenses.

    Roll on September 12th - I just hope they don't reject our application but with total secured & unsecured debts of just under £200K (inc mortgage) and a household income of £27K (gross), it seems unlikely!

    Hi Onamission - We are in a similar position with a mortgage and secured loan. Total secured and unsecured debts amount to about £250k!! We have about £20k negative equity. My OH and I went BR last Thursday and have our OR interview on Monday. We have not rented anywhere yet, but will be looking to. We will be looking at the small ads in the papers (not letting agents) and hope we can find somewhere this way. As we cannot afford mortgage and secured loan payment, we will definitely be moving. However, if you can afford your mortgage and secured loan, then you will be able to stay in your house (buying back the BI). To be honest, even if we could afford mortgage and secured loan, I am not sure we would want to keep those debts ayway.

    Both my OH and I have good days and bad days emotionally. One minute you are up and the next minute you are down. I think it is just the nature of the best. Can't wait until things are on an even keel.

    I was interested to read that you might be allowed to stay in the house for 12 months because you have a child. This would be great for us (we have a 12 year old daughter) and would mean we could save towards rent perhaps. Does anyone else on the forum know anything about this please? If so, I would be keen to have your thoughts.

    We couldn't afford to keep up the secured debts and living costs so it's bye-bye home but we're quite glad to be honest as we don't want to be here any more. We wanted to move a long time ago but there's no way we could do it with the mortgage and SL on the house.

    We ran the 12-month grace period past CCCS today and she confirmed it - although you may get a court summons once you are 3 months in arrears, you can appeal the normal 28 day eviction notice asking the judge for a longer term and many creditors agree as they don't want the bad press of kicking a child out onto the streets. Hope that helps.
