I see.
I seem to vaguely remember that a few people have negotiated for a relative to buy out any excess value in a vehicle so that it doesn't have to be sold.
Not sure if that was on here or another site/forum though.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Well, it is BR day on Friday and I still haven't got my SOA completed so must get on with that tonight... get ready for a barrage of questions!!0
-
Well... forms are almost complete, just a few last bits.
I've just phoned the court to see how many copies we need to take with us and was told just the one, yay! I also asked how long we should allow for so that we can bring enough snacks/toys etc for our toddler who we have no choice but to take and was just told to allow for an hour. Wow. By lunch tomorrow we'll be over the biggest hurdle.
Things are slowly getting there on the moving front - we've postponed the Scotland dream again for a while as it was proving just too difficult to sort out new employment for OH as well as find a house and save up the 6-months rent they wanted on top of the deposit, admin fees and removal costs all before baby is due. Instead we are now looking at relocating to nearer OH's current job, that he does actually like, which will cut 3 hours off his daily commute and save £110 a month in train fares. We want to be out of our house by the end of October ideally and have found an area we like the look of so we're off to view a house in a couple of weekends time. The admin fees are reasonable and they only asked for 3-months rent up front as well as deposit which we still won't have in time but are hoping family can help us out with a rent advance and they were even ok with our dog. Even if this particular house goes before we get to view it, there seems to be a few going in the area so we'll hopefully be okay.
I feel strangely calm about tomorrow, I've come to terms with what is happening and know that it is in the best interests of my family. Not long to go now...0 -
Well... the deed is done. As of 11:56 today, my huband and I are bankrupt.
It was all very relaxed and friendly, the judge likes to see the people she is dealing with but was lovely and spent more time talking about our son's box of raisins than she did the actual bankruptcy proceedings. We were in and out of the court within the hour and are now just waiting on the initial phone call from the OR.
I had a little wobble when it was all over, the brave face slipped just a touch but a few tears fell - knowing that something is for the best and will change our lives for the better doesn't take away the guilt or the shame of going through it in the first place - anyway, it's done now and it's time to start over again.
We've been into the Co-Op and filled the form in for a joint CashMinder a/c which someone will key in tomorrow and they took copies of our ID whilst we were there so hopefully that will all be quite straightforward.
So, that's the unsecured creditors sorted, now we just need to find somewhere to live and get the funds required to move asap so that we can hand back the house and get rid of our last 2 creditors.
Hubby fancies a couple of beers tonight, I may just have to splurge and get myself some schloer to celebrate with him!0 -
Well done the pair of you and good luck with the house hunting.0

I've just been on the phone to the Co-Op as I decided I'd like to have a sole account as well as the joint account we applied for in the branch on Friday which I will have my benefits (CB & CTC) paid into. It turns out that nobody at the branch bothered to key the joint app in yesterday so I was not yet on their systems so they took all my info over the phone and I was accepted - yay! - which bodes well for the joint app I hope. CB isn't due to be paid until w/c 6th Oct so I'll hopefully have time to get the payments changed over to the new a/c.
I also ordered myself a BaBeeCard pre-pay Mastercard last night as it provides some fab discounts in many of the places I use frequently like Asda, Ocado, Boots and Mothercare. I love to be organised and find that separate accounts help me to budget plus I have the piece of mind that I can't jeopardise the direct debits going out of the bills a/c and cause any to bounce if I'm not dipping into it on a regular basis.
I'm a bit disappointed that the OR didn't phone on Friday afternoon as advised by the court so I can probably expect that call tomorrow morning instead - I must remember to turn the ringer on then!!! Poor DH will be in work for it so will have to make a hasty exit to somewhere he'll be able to talk.
I've been going through a lot of the forums today, especially the BR friendly ones, and have already spotted a flaw in our current pet insurance and will get that switched over the M&S as soon as I've got a card to pay with. Same amount of premium, better cover provided and no question at all about being BR.
We are currently with Barclays for home insurance, Sky for TV/internet/calls, BT for landline rental and O2 for mobile contracts - does anyone know if we're likely to get turfed away or are they usually quite accepting? We have never missed payments on any of them and been with most of them for at least 2 years (just 1 year with BT). I need to prepare myself when we move and for when the home insurance is up for renewal next month and get back-up plans researched if there's a chance they won't touch us any more.0 -
I phoned my Creditors/DCAs this morning and advised them of my BR, every single one handled it politely and professionally, some even bordering on friendly, and it means I can have the phone ringer turned on again. Hurray for caller display so that I can contine to avoid FP.
The ORs office also made contact this morning. I spoke to a lovely girl first of all who took a few more details and then a short while later, the examiner called to arrange our telephone interview so we're booked in for Friday morning. DH asked what the examiner was like and the girl laughed a little and said she's fine. Having now spoken to her myself, I'd say she sounds a bit official and professional but helpful - I guess we'll find out on Friday. DH first at 9 and then me afterwards, at least I already know mine is going to be quite complicated because of trading, divorce inc. transfer of property and more creditors.
The car is due its MOT this week and we weren't sure what to do about it, especially as it is essential to go a view houses 50 miles away next week. We've been told to carry on as normal and that there is a good chance we'll be able to keep it as I need it for business but warned that it is up to the OR at the end of the day and not the examiner.
Anyway, judging by a certain aroma that has just hit my nose, it's nappy time for a certain little someone!!0 -
Hi OAM,
Sounds like it's all going pretty well for you
We didn't have any problems with Sky, BT, mobile providers or home insurance - as long as you're up to date with your payments, then you should be fine. It would probably be different if you were looking to join them as a new customer, but as an existing customer you should have no problems at all, well we didn't
Lots of luck to you both for Friday xYou can't control everything in life....... your hair was put on your head to remind you of that

Phew, that's the OR interview done!! :j
They spoke to OH first and grilled him on the house and secured borrowing and all the joint stuff for about 45 minutes. Then it was my turn but as he'd already answered a lot, mine was relatively easy and was done within 20 minutes. Woo!
I am so relieved that it was straightforward and the Examiner seemed to understand our position and how we ended up in this mess. She is going to push for exemption on our family car especially as I am prepared to sacrifice my sole car which is a HUGE relief!!! She will still need to get the family car valued but if it comes in close to the £2,500/£3,000 then we should be okay. Please keep your fingers crossed.
There was absolutely no mention of our I&E, is that normal?? Does it mean it's ok or that she just hasn't looked at it yet? Hmmm... perhaps a separate thread would be better for that question.
Upon her advice, OH just phoned the mortgage co to tell them we're now BR and we asked the question of vol repo but they won't send any forms or information out until we say that's what we're doing for definite. They could make moves to repossess as soon as the end of the month but I know from speaking to the debt agencies that I could just turn up at court, heavily pregant with young toddler in tow and stand a good chance of the Judge giving us more time to vacate. Hopefully it will be a formality anyway as we hope to be out of here within the next 2 months.
I wonder what happens now then0 -
Well, today we told OH's parents and although sad and a little surprised they are being very supportive. They've unconditionally offered to help with getting the up-front rent and deposit together which is a huge relief. I'm sure they are slightly disappointed in some respects but then so are we, the fact remains however that we've taken some massive steps to make the future better for ourselves and our growing family. I know my OH found it difficult but you could almost see the relief pour out if him once it was out in the open and I know I'm going to get my old OH back rather than the stressed out one that's been hanging around lately0
