    Hi sutton

    I had a settled default removed a few years back which was placed by Shop Direct Financial Services.

    I wrote to SDFS stating that I thought they shouldn't have recorded a default on my credit file because part of the definition of a default is that an agreement has broken down between customer and company, but I had signed no such agreement.

    They wrote back saying that they would remove the default as a gesture of goodwill (:rolleyes:) because the debt collection agency they sold the debt to had referred it back to them in the wrong timescale (I have no idea what this has to do with anything!) - this of course is complete !!!!!!, they knew very well they wouldn't be able to provide a copy of the default notice had I requested it and wanted me off their case. I wasn't bothered whether they admitted being wrong or not, I got what I wanted!

    I later tried to get all information they had on my credit file removed on the grounds I never consented to my information being processed in that way but they refused. Unfortunately the Information Commissioner's Office agreed with SDFS :(

    Also, I helped a mate get rid of a default recently which had been placed by HSBC. This was as a result of them not being able to produce the paperwork but took ages (around 7 months).

    I think the Electoral Roll may have a little to do with it. I'm not sure what else. :(.

    I'm going to SAR all the CRA etc soon, just can't quite afford it yet. :(

    Not sayin underground is lying but there must have been another reason i.e not CCA ( as underground said ) or something

    I think that they had no CCA too. I think Underground mentioned it before.

    Perhaps you should focus on if they have copies of the default notices.

    I'm guessing you never received them and would like a copy right? ;)

    You may well have seen it before. I'm not saying it works or condoning such action, but it's an avenue to consider.
