I'm having the very same problem with Next (Cabot DCA) and Capital One (Robinson and Way DCA). Next haven't got a CCA, I never signed one. They haven't admitted quite yet, but they will when I take them to court. ;)

Unfortunately Capital One have found mine which has put a spanner in the works.

So far it's take 2 months and I'm no further in getting them removed from Experian. Funnily enough they have both been removed from Equifax. Not to sure why.

I don't care if they say they are wrong or not, all I want is the same as you, for the bloody things to be removed.

Perhaps you should focus on if they have copies of the default notices.

I'm guessing you never received them and would like a copy right? ;)

Have a look at this: http://www.learnmoney.co.uk/credit-cards/remove_default_notice.html

You may well have seen it before. I'm not saying it works or condoning such action, but it's an avenue to consider.

    Regards

I've got 3 defaults which should come off on 28/05/09, Experian has 28/05/03 as the default date set correctly but the other two (EQ, CC) are taking longer to sort out. It looks like I have to tell Cahoot explicitly to sort out each CRA individually as they did EX but didnt bother with the others. Its a real pain as I want to get a mortgage in June. If I cant get EQ and CC sorted in time I want to know with mortgage lenders only check EX as I'll have defaults on EQ and CC even when I shouldn't.

So far, it looks like I'll be going back to Abbey...

  • I had an IVA starting 28/05/03 which means that all my default dates should be set no later than this, the creditors are quick enough to registerthe defaults but really drag their heels updating the information so it is correct.

    Hi sutton

I had a settled default removed a few years back which was placed by Shop Direct Financial Services.

I wrote to SDFS stating that I thought they shouldn't have recorded a default on my credit file because part of the definition of a default is that an agreement has broken down between customer and company, but I had signed no such agreement.

They wrote back saying that they would remove the default as a gesture of goodwill () because the debt collection agency they sold the debt to had referred it back to them in the wrong timescale (I have no idea what this has to do with anything!) - this of course is complete !!!!!!, they knew very well they wouldn't be able to provide a copy of the default notice had I requested it and wanted me off their case. I wasn't bothered whether they admitted being wrong or not, I got what I wanted!

I later tried to get all information they had on my credit file removed on the grounds I never consented to my information being processed in that way but they refused. Unfortunately the Information Commissioner's Office agreed with SDFS :(

Also, I helped a mate get rid of a default recently which had been placed by HSBC. This was as a result of them not being able to produce the paperwork but took ages (around 7 months).
