Car Problem - BMW
Bought the BMW 1 series on 27th March this year from Douglas Park in Hamilton. Everything was going well until 4 weeks later the timing belt went. Took back to the dealer who got it repaired gave us a loan car for the week that ours was in getting fixed.
However, this Friday (11th July) I took the car back again as there was still some shuddering when changing gear only to be told again that it was the timing - again I said....surely that cant be right....he was adamnt it was but as a "gesture of goodwill" they will order the part in again and fix it for us.
Im due to take the car in this Thursday however, what are my rights with regards to this as I find it unacceptable that the same problem has arisen so soon after buying the car?

Sounds to me like they did not fit the timing belt correctly which means the timing is out. I can't think why a car dealer would think it acceptable for the timing to be out - but it sounds to me like they are fixing it under warranty.
If it is *not* a non-interference engine (i..e. they had to replace valves and cylinder head) be glad it happened now in warranty and not a few years down the line when it would have cost you thousands out of your pocket to repair.0 -
Under the sale of goods act - do i have to accept this? Can I return the car as how am I going to be sure this isnt going to keep happening? Its really annoyed me and is such an inconvenience.0

How old is the car , is it still under warranty? I would give your local trading standards a call , the timing belt is critical and if it wasnt done properly other serious damage may have resulted. i find it strange they offered to do it again is that an admission of guilt?0

on a brand new car they should have replaced the whole engine under warranty if the timing belt has snapped,i wouldnt be accepting any less....work permit granted!0

its a 54 plate but I only purchased it in March - Im def contacting consumer direct about it - its the "gesture of goodwill" thats riles me!0

you might also want to consider contacting bmw uk customer services direct and causing a stink to see what they offer. the car will have been sold under bmw s approved used car scheme and a timing belt shouldnt go on a 54 plate after only 3 and a half years0

it shouldnt be a gesture of goodwill,dont let them fool you,but i wouldnt get to upset over it,on a 54 plate car i bought 2nd hand i wouldnt really be expecting the whole engine replaced,but i would expect the timing belt and any other parts damaged replaced under warranty.
if you didnt cause the fault and it isnt general wear and tear then its warranty.
ps,im from motherwell too.;)...work permit granted!0 -
Thought the 1 series were on a timing chain? They are a common fault on them, I've heard of a few of them rattling/snapping and having them replaced under warranty from BMW.
As for the shuddering on gear changing, this could be the DMF. Which seems to be prone to failing on most cars these days.
We seem to be doing about 2 or 3 a week now...!!0 -

Hello fellow Weller - The car got a full MOT before we got it. I shouldnt have expected to get the timing changed once never mind twice. My first "fancy car" and Im beginning to think Ive made a big mistake.0 -

It was them that diagnosed it as being the timing so I can only go on what theyre telling me0
