Restrictive Covenant with non-existing company
Thinking of buying a house which, on the register of title, lists a 1951 restrictive covenant between a certain company (the owner at the time) and the purchaser (including all future purchasers), stating that any building or extension cannot be erected without written approval from this company. Googling the name of this…

"Draft details" from estate agent?
Hi all At a house viewing, if an estate agent gives you a copy of the house's details marked with "DRAFT DETAILS", does that have any legal implications? For example, does it mean that any information on the document is not legally binding in the way it would be if it was not draft? Thanks for any guidance.

Buying a house from the church, owners deceased
I am buying a house from the church - the owners have passed away and left it to the church. We are now getting close to completion - my solicitor has received the property information form, however much is left blank. She has gone back to their solicitors on this point, however I can only imagine that the church will say…

Background Check/Tenant Referencing - Overseas Tenant
Hi All, wonder if I could benefit from some of your advice. Have been doing viewings for my flat, the vast majority seem to be Europeans and I am just curious how I would go about doing a background/tenant referencing check for them ? As to date my past tenants have been from the UK and I normally use rentchecks to alert…

Estate agents suggesting tax evasion?
I've just had an interesting conversation with an estate agent (who shall remain nameless for now). I've seen a house in a popular area advertised at a "fixed price, £250000" This is clearly for stamp duty reasons, however the agent told me that as the house was in a very popular area and would clearly sell very quickly…

Capital Gains tax - will I have to pay any?
Hello. Understanding tax isn't one of my strong points so would be grateful if anyone could help. I bought a property in 2005 with my partner at the time. In 2007 we split up and I bought him out by remortgaging and a transfer of equity. In 2011 I moved out and rented the property out and bought another house with my new…

Disagree with TDS
So we are in dispute with our LL & Agents over the amount of deposit they wish to keep. It runs into the £1000's and completely unjustified. We were sent a 'check in' at the start of the tenancy but never signed it, it wasn't fit for purpose and we questioned both the documents integrity alongside the professionalism of…

Slightly different situation from the norm...
I'm currently awaiting a mortgage offer on my first home. My situation is slightly different from others, as it is a relatives house I am buying. Once everything is sorted and I officially own the house, I won't actually be moving into it for a good few months - reason being the relative is moving into the house I live in…

Has anyone lost a house due to a delay in the survey being done?
I've just been reading this article that says in some areas there are big delays in the survey being done due to a shortage of surveyors. It also says that some buyers lose the house when the vendor accepts another offer or puts it back on the market. I truly can't see how this can be so...surely if there's a shortage the…

outstanding to good school status
We have recently offered £300k on a house next to an outstanding school. However the school have now been downgraded to good. My question is what do you think the house value has gone down by given the schools new rating? My guess would be 10%.

Valuation
Been informed today that the earliest countrywide can do a valuation on the property we're trying to purchase is the same week we're supposed to exchange contracts (28 day exchange as probate and corporate client). I have read about maybe being able to use a different surveyor who is on either countrywide or nationwides…

Planning permission question
My house in South Devon has a 30' x 6' conservatory attached at one end. This was part of the original 1970 build although it doesn't show on the plans. There were a number of departures from the plans but the previous owner who commissioned the house build confirms that the conservatory was built with the house. I am…

Securing sash windows
Hi All, Just looking for some advice. My flat is part of a Victorian townhouse conversion, and has the original (circa 1850) sliding sash windows.I live on the ground floor. Chain possibly collapsing - help!
Hi, Up until today we thought we were a few days away from exchanging on the sale of our house and purchase of one. However, the estate agents have phoned to say our vendors have pulled out of their purchase due to an adverse survey and issues with building regulations. Purchase of a Freehold which contains a leased garage
Hi Everyone, I have purchased a new build coach house with two garages beneath. One is mine and the other is a leasehold between the builder and a social housing organisation. Should the leasehold have been rewritten to include my name as the free holder or does the lease remain unchanged? There is also a disposal clause…
