I have been reading the posts for people who have successfully challenged a PCN from VCS for allegedly stopping on the road near to John Lennon Airport, but the posts are now getting dated and having received one of those lovely invites to donate money to VCS, I am wondering if anyone has any updated advice on what to do when receiving one of these PCNs.


In particular;
  1. Although the owner of the vehicle at the alleged time, I was not driving it. Is there a statutory obligation on me to divulge who the driver was ? If I don't divulge it is there a comeback that VCS can take ?
  2. The VCS signage which has been duplicated on many forums may appear clear in the daylight, especially if walking past or taking the time to study it, but in the early hours of the morning when it is dark, how are we expected to notice this sign ? Is this a viable defence ?
  3. Does anyone have a recent initial notice of appeal to VCS which could be copied and pasted?
  4. The latest POPLA appeals letters that have appeared on various forums, are these still current, or has recent cases changed this approach ? Does anyone have a copy which I can use?
  5. Do Bank Holidays e.g. Christmas, Boxing Day etc. count within the 14 and 28 days quoted by VCS for settling/appealing the PCN?

Plus any other advice please.

    1. VCS do not use keeper liability so you can appeal as follows

    I am appealing as keeper. I was not the driver. As the notice to keeper does not contain the required elements of section 9.2 of POFA (specifically 9.2.e and 9.2.f) there is no keeper liability.

    2. The signage is not readable at 40 mph...unless of course you think otherwise. This is the major problem with this site, the one VCS cannot solve, and the probable reason they don't go to court for tickets here even though they do elsewhere.

    4. VCS dont use POPLA, but the IAS. This is essentially a kangaroo court. If VCS turn you down you can appeal as per 1 and it will then be amusing to see if the IAS assessor is either biased or incompetent by trying to disallow your argument.

    5. All days count. Email your appeal to VCS today.

    So to recap...you have a slam dunk legal reason why you are not liable and should use it. However, VCS and the IAS will ignore it. After that you will get threatening letters, but VCS are not stupid enough to kill the cash cow and actually go to court at this location. This is essentially a scam where they farm the site with no real intention to manage it properly - if there were, there would be proper signs directing people to the hidden and secret free car park. There is therefore no need to pay.

    The scammers that infest some of the smaller airports are in cahoots with said airports as it is a (allegedly) mutual financial arrangement ....

    Go back two years and you would have won this at a POPLA appeal ..... however in the world of PPC's they created another trade body (the IPC) that have a (again allegedly) kangaroo court :eek: (the IAS) The IAS seem to treat appeals as a lottery 80%+ loose irrespective of the evidence.......


    you therefore can, after reading the below, do the first appeal (a new template appeal for the IPC is imminent) ,and then ignore .... or do the appeals as a paper trail.

    VCS did try out their first small claims court case over such ....and as predict that they pulled out before the trial ..... . They did not dare try placing this before a real judge! and have not yet tried again ..... I wounder why ?

    Follow this advice from hoohoo to the letter, or decide not to bother with IAS stage. You need to make an informed decision at that stage because we know you will lose at IAS if you bother with that kangaroo court - and you need to know that or decide that stage isn't for you.

    It would be interesting to see one of these get to court, although JLA own the road, so are free to do as they wish with it. Their excuse for employing VCS to police it is hogwash. Also the roads on the industrial estate next door.
    They quote the need for security and access. Security is bo**ocks as anybody can park on 90% of the airfield perimeter. You can actually park at one end and stand at both ends directly under the flightpath of the runway legitimately.
    As for access in an emergency the emergency vehicles would come into the airport from Hale road not Speke hall avenue. Even if they did need to use Speke hall avenue it is a 4 lane dual carriageway so I doubt it being blocked.
    In fact the only time it could get blocked is if they had an emergency and stop the traffic entering the airport. However it is never that busy to become blocked.

    Its just a cash rakeing in syndrome. :eek:
    PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:
