Hi I have just recived a letter from Citicards in reply to my request to refund charges of £825 for the past 6 years. They have mentioned a recent case in NI where they were successful in getting the case dismissed due to the court deeming the charges as being fair etc etc. Does this mean I will have to give up.........or shall I carry on rewardless with letter number 2??
Any advise appreciated.

    I requested my statements from citicards last week, waiting to hear.
    I imagine this is a delaying tactic, so press on !
  • They are allowed 40 days in which to send you your statements, they will wait until the last minute to send them on. If you havent received them by the end of the deadline get in touch with the Information Commissioner and report them for non-compliance with your DPA request

    Citicards can be rather slippery. The case in NI is still under appeal as far as I'm aware. Continue with the process.

    We are claiming £2,890.92 from charges incurred from 2000-2005.

    Citi Cards have written to us claiming:
    'In over a dozen recent court cases involving Citi, we have successfully argued the fairness of the above policy and the fairness of the £12 charges. The cases have all resulted in the claims being dismissed and the courts have implicitly held that the policy is fair and the charges reasonable, being in line with both OFT guidance and common law principles of damage for breach of contract.'

    Just wondering if anyone knows anything about these dozens of cases?

    I`m awaiting the statements from citi - i`m guessing this is just a `puff up your chest` routine from the bank.

    Citi were the first people I got a refund from. they offered me the difference between £12 and what they actually charged, which I accepted, to the extent that I didn't pursue it further.

    They said something similar to me as they said to Niftythrifty in their letter. What they say is quite wrong and i suspect they are well aware of that. As for the 'dozens of cases' - I would bet money that they don't exist either.

    Leter says over a dozen - and yes they do exist.

    Can anyone give me any advice on Citi Card please? I recently wrote asking them for just over £800 back. (It is a closed credit card account with about £500 balance remaining). They have written back to me saying that they believe the OFT recommended charge of £12 is fair and that in over a dozen cases involving themselves, they have successfully argued the fairness of the charges. They say this has resulted in all the cases being dismissed. Is this true - if it is true I'm sure I would have seen it reported.

    I presume this is intended to make me think I will lose the case if I make a claim against them. What should I do? And do credit card companies just refund the difference between the charge and the new £12 or has anyone had them pay up the full amount? Please advise as I need to know how to respond.

    Also I claimed approx £500 from Littlewoods Visa operated by Barclaycard who have offered me the difference between my charges and the £12 charge, being £176. Should I accept this or is it worth pursuing further?
